I passed your email to the case team who handled your request and they
have advised the following:
Following a search of records, we can confirm that we have issued all
copies of grid connection letters held. We do not require every version of
the grid connection letters. The station was accredited on 23 March 2018
and any documents issued after this date would not be held.

Why would the final grid connection letter not be required or supplied as part of this request. Surely this would be the confirmation that is needed to show that the plant is capable of operation.

Thank you for your email.
We note that you have you requested an internal review of our response to
your request for information logged under EIR2021/00550. As a public
authority, Ofgem has a statutory duty to release information under either
the Freedom of Information Act 2000 (“FOIA”) or the Environmental
Information Regulations, subject to certain exemptions (FOIA) or
exceptions (EIR) contained within the respective legislation.
In line with the ICO guidance, our final response issued on 29 June 2021
stated:
“Under regulation 11(2), you must contact us for a review no later than 40
working days after the date of this letter.”
The ICO has published detailed guidance on the length of time in which a
requestor can ask for representations under the EIR. This is available on
the ICO website at:

As the 40 working day time frame has been exceeded, we are unable to
consider a reconsideration for the request EIR2021/00550.
However I did pass your email to the case team who considered your request
and they have advised the following:
As this was a Grace Period application it required a grid connection
letter which was dated and received prior to 2017. As stated in our
guidance, grid connection offers and agreements may vary as a project
progresses. In these cases, we will generally not take these changes into
account for our grace period assessment, as the legislation does not ask
for the latest offer or agreement. For example, if an original planned
grid or radar works completion date was given which was before 31 March
2017, but the network operator subsequently modified this to after 31
March 2017, we would not take this variation into account – our assessment
would be based on the original offer and agreement.
On this basis, the original the application was progressed. Any changes
are not relevant as requirements were met. For further information, please
