" The City of Westminster operates the Local Government Pension Scheme which provides death and retirement benefits for all eligible employees of the City Council and the admitted bodies.

The Council has delegated the investment management of the scheme to the Superannuation Investments Committee who decide on the investment policy most suitable to meet the liabilities of the Scheme and the ultimate responsibility for the investment strategy lies with them.

The Committee has eight specialist investment managers to manage the Fund's investments. The managers' activities are constrained by their detailed Investment Management Agreements, which incorporate the statutory restrictions.

Thank you for your recent request to the council. You asked to be provided
with the following information:

 

Under the FOIA 2000, please provide all written contractual agreements
between Westminster City Council and The Bank of New York Mellon.

Firstly, please accept our apologies for the delay in responding to your
request and any inconvenience this may have caused you.

 

You have requested access to all written contractual agreements between
Westminster City Council (WCC) and The Bank of New York Mellon (BNY
Mellon). The council has been involved with BNY Mellon since 2006. As
such, “all written contractual agreements” as defined in the request the
council will have all reports and trade confirmations provided by BNY
Mellon to WCC, as well as all trade instructions the council has given BNY
Mellon. These can number up to 10 a week.

 

It is estimated that to determine what information is held by the council,
and its location in respect of your request would exceed the appropriate
limit of £450 set out in the Freedom of Information (Fees and Appropriate
Limit) Regulations 2004. It is estimated that it would cost £38,225 to
comply with your request. In accordance with the Freedom of Information
Act 2000 this letter acts as a Refusal Notice.

 

You have the right of appeal against the decision.  If you wish to appeal
please set out in writing your grounds of appeal and send it to the
address at the end of this email.

 

Should you still be dissatisfied with the outcome of any such complaint
you have the right to make a complaint to the Information Commissioner,

Advice and Assistance

 

Set out below are some possibilities that would allow you to redefine your
request within the appropriate limit:

 

1) “All written contractual agreements” – do you require only the contract
between WCC and BNY or do you require a sample of the weekly reports /
instructions

 

2) Do you require the written reports and trade confirmations and/or trade
instructions with BNY Mellon within a specified period. As an indication,
the council receives an average of 5 of these a week. To determine all
transactions carried out on a daily basis would take approximately 1 hour.
It is therefore estimated that it would cost £30 to locate all
reports/trade confirmations / trade instructions for a particular month.

exemptions that may apply under the FOI Act, and this email does not
