Your request for information on Balfour Street and Ludlow Street costs

 

Although we do hold the information that you have requested, we estimate
that the cost of complying with your request would be more than £450. This
amount is called the appropriate limit and is specified in regulations.
When it would cost more than £450 to locate, retrieve and extract the
information that is requested, section 12 of the Freedom of Information
Act allows us to refuse the request.

 

The reason that your request exceeds the statutory cost threshold is
because we have identified 626 invoices over £500 in relation to the
clearance of Balfour Street, Ludlow Street and Wellington Street. The
majority of these invoices are in storage and would require a considerable
amount of time to locate, retrieve and extract.

 

It may be possible to provide a list of the expenditure for the clearances
and you may wish to select which copies you require from there.

 

If you make a new request for a smaller amount of information, it may then
be inside the appropriate limit, although I cannot guarantee that it would
be and we would have to assess your new request.

Dear FOI,

I note that you have responded to my enquiry under the Freedom of Information Act, rather than the Environmental Information Regulations, even though it has a clear reference to the built environment and administrative decisions regarding urban planning. I am not going to pursue this point at present, though there are obviously implications in relation to the appropriate charging regime.

You have stated that you may be able to provide a list of the expenditure for the clearances, and I would like to receive this. If you can generate, from your finance system, a list of invoices, including date, payee and amount, this would be acceptable. Could you also please indicate the number of invoices in excess of (a) £1,000 and (b) £5,000.

We have now considered your request for information and your clarification
of the information that your require.
 
We are inclined to agree with your suggestion that the appropriate
legislation would be the Environmental Information Regulations 2004 as
environmental information is exempt from the Freedom of Infomation Act
2000 section 39 and the information is regarded as environmental under
regulations 2(1)(c) and (f).
 
I attach for attention a list of expenditure as it is held by the
authority. The council does not hold composite numbers of invoices over
certain figures as there is no requirement to hold this information fo
operational purposes. Regulation 12(4)(a) applies.
 
 
The information supplied may be used for domestic or journalistic
purposes. Its use for commercial gain may be subject to the issue of a
licence under the Reuse of Public Sector Information Regulations 2005.
