(2) Subsection (1) does not exempt the public authority from its obligation to comply with paragraph (a) of section 1(1) unless the estimated cost of complying with that paragraph alone would exceed the appropriate limit.
(3) In subsections (1) and (2) “the appropriate limit” means such amount as may be prescribed, and different amounts may be prescribed in relation to different cases.
(4) The Secretary of State may by regulations provide that, in such circumstances as may be prescribed, where two or more requests for information are made to a public authority—
(a) by one person, or
(b) by different persons who appear to the public authority to be acting in concert or in pursuance of a campaign,
the estimated cost of complying with any of the requests is to be taken to be the estimated total cost of complying with all of them.

Dear Foi, Customer,

Thank you for your response. I am some what shocked that it has taken this long to be told I will not be receiving the information requested. Assuming my request will take too long, is it possible for you to provide the requested information for the first three developments I have listed instead?

In my request I asked for information relating to 6 developments, according to yourselves it would take 35 hours to secure the required information. On that basis I see no issue with providing half the requested information. If half proves to much could you please let me know, prior to 20 working days later, how many out of the 6 developments you are able to information for.

I made my FOI request on the 20th October, I am well within my legal rights to have access to such information. The fact that it has taken two months to tell me the request is exempt is ridiculous.

Can you please respond asap with either the requested information or can you update me with how much work you will be able to complete within your allotted time. I am assuming that as you have calculated 35 hours to complete work on 6 developments, you must be aware of how much work you can complete within your legislated allotted time.

Yours sincerely,

C Gordon

Dear Lewisham Borough Council,

If I do not hear back from you by tomorrow I will have to make a complaint to the information commissioner/request an internal review. As my request was initially made in October and it took 2 months for an exemption response, covid or not, this is simply ridiculous.

Yours faithfully,

C Gordon
