1. Does your enforcement agent contract allow your enforcement agents to issue an
indemnity against prosecution for themselves without the agreement of the council in
cases where they have wrongfully seized and to vulnerable
2. Have you ever allowed bailiffs to make their own settlement agreements where goods
have to be returned?
3. Would you allow enforcement agents to breach the equalities act if it meant your
business rates were collected?
4. How would you react if they did this without you knowing?
5. Would you class a secret indemnity which achieves a gain at the cost to the
vulnerable victim a material breach of contract .?
6. Must enforcement agents always report failed levies and a full report when dealing
with vulnerable customers

1. Does your enforcement agent contract allow your enforcement agents to

something that can be answered under the Freedom of Information Act as it
relates to a hypothetical situation rather than known information.

 

5. Would you class a secret indemnity which achieves a gain at the cost to
the vulnerable victim a material breach of contract? Again this is a
hypothetical question and not something that can be answered under a
freedom of information request.

 

6. Must enforcement agents always report failed levies and a full report
when dealing with vulnerable customers. Information relating to all
actions and levies is recorded by enforcement agents in the individual
case notes and is available to be viewed at any time.

Dear Johnson, Emma (Income Collection Manager),

hello as per the 100 other responsible councils who have answered all questions i hope you can revisit the hypothetical questions

based on the fact

all the answers should be contained within your contract and code of ethics
and that they are in the public interest

bailiffs should be without doubt that certain secret indemnities namely one they obtain from a vulnerable person after a failed levy should be declared to the council before presenting .

the other councils have accepted they do hold these answers within their code of ethics and contract

plus this can be taken as a warning their is one large bailiff firm producing indemnities you might not know about.leeds cc are about to be sued for negligence based on not protecting someone under a duty of care

Dear Johnson, Emma (Income Collection Manager),

thank you for your answers

however over 100 other councils have answered the ones you havent based on their contract and their code of ethics
whilst i agree for you it is hypothetical it is important in the public interest that the public are aware of where they stand if bailiffs take actions the council are not aware of ,especially those that break equality law.

these answers are contained in the 2 documents mentioned

please try again using the answers that would apply if you were to find out secret indemnities ie deals done with vulenerable people that should not be done which are concealed from you occur
