Having now tried to get many freedom of information requests answered.It seems you are very selected in which ones you will answer
i ask now under this account you answer this request promptly and in the manner the other councils you have seen have
Failure to do so will again look like a clear obstruction given the sensitive and seriousness of the request

we do hold the information requested. Please see the response below

Does your enforcement agent contract allow your enforcement agents to do any of the following?

Luton:For reference we are mainly an In-House Enforcement Agent Team, we only
use external Enforcement Agents for out of area cases.

Would you allow your agents to issue a indemnity against prosecution for themselves without the
agreement of the council in cases where they have wrongfully seized and to present it to
vulnerable people

Luton :No.

Have you ever allowed bailiffs to make their own settlement agreements
where goods have to be returned?

Luton:No.

Would you allow enforcement agents to breach the equalities act if it
meant your business rates were collected .

How would you react if they did this without you knowing?

Luton :I would meet with them and seriously look at ending their contract.

Freedom of Information Request (Ref: 254204)

I refer to the above and your requests dated between 5th October 2019 & 9th January 2020. I have contacted the relevant services and now provide a response to your requests.

I have amalgamated the 25 requests that you have put in, I have attached the list of questions and answers. We have not answered any questions which asked for an opinion as these are not coved by FOI.

I trust that this response is satisfactory. If however you are dissatisfied with this response you have a right to appeal to an independent officer within the council. They will re-examine your request and assess whether we have adhered to the requirements of the act. Should you wish to follow this course of action please address your concerns in writing to the above address.

You also have a right under Section 50 of the Freedom of Information Act to ask the Information Commissioner to decide whether we have met with our obligations under the act. The Commissioner has however made it clear that she expects all applicants to exhaust internal appeals procedures prior to making such an application. Dear Steve,

I am sorry you were not happy with the response provided to your 25 requests. I have reviewed your concerns as the manager of the information management and governance requests team and provide the following response in accordance with stage 2 of the councils complaints procedure for freedom of information requests.

Having reviewed your 25 original requests, I consider that amalgamating the questions was a fair and reasonable way to respond as all the requests you submitted related to broadly the same matter. As such I do not believe there is any requirement to provide separate responses to each of your 25 requests.

In addition having reviewed the response to your questions I consider that appropriate responses have been provided in all cases where your questions are for recorded material held by the council, and not requests for the opinions of the council on particular matters. I do not therefore uphold your appeal.

This concludes my response at stage 2. If you remain dissatisfied you may contact the information commissioner's office via their website, www.ico.org.uk.
