Assessment of Single Equality Schemes

On the EHRC web site you say (http://www.equalityhumanrights.com/advic... ):

"As part of our role to monitor and enforce the public sector duties, the Commission assesses equality schemes. We do this to determine the extent to which schemes have enabled public authorities to meet the general duties. These assessments are done using standard templates to ensure consistency."

I have not been able to find a copy of the assessments on the EHRC web site.

Could you therefore please send me:

- copies of all the Single Equality Scheme assessments that the EHRC has done in the last 12 months;
- a list of all the Single Equality Scheme assessments that have ever been done by the EHRC, broken down by year, and red, amber and green status; and
- a summary of the enforcement action that the EHRC has taken in regard to Single Equality Schemes.

Subject: Freedom of Information Request

Dear Mr. Swain,

Thank you for your email dated 17^th January 2011, in regards to your
Freedom of Information request (FOI).

In your email you state that "Much of the information that I requested was
just statistical in nature". I have checked your request again and it
states the following:

. copies of all the Single Equality Scheme assessments that the
EHRC has done in the last 12 months

. a list of all the Single Equality Scheme assessments that have
ever been done by the EHRC, broken down by year, and red, amber and green
status

. a summary of the enforcement action that the EHRC has taken in
regard to Single Equality Schemes

Your request requires more than just a statistical response because you
have asked for copies and lists of Single Equality Schemes that the
Commission has undertaken along with a summary of enforcement action
taken. This means that the Commission is required to process your request
in line with the procedure of the Freedom of Information Act 2000 (FOIA
2000).

The Commission has a duty to consider any exemptions that are, or may be,
engaged therefore requiring an assessment of the public interest test in
disclosure of the relevant information requested.

The Commission must give Consideration to any potential harm to the
commercial interests of a third party organisations and of the EHRC in the
release of information relating to your FOI request. This mean that we
must obtain and consider confirmation from third party organisations, as
to whether they consent or have any objections to the release of the
information you have requested.
