Dear Department for Business, Energy and Industrial Strategy,

Can you clarify non EU family members of UK citizens that have exercised their treaty rights elsewhere before returning to the UK with the family who is a qualified person in working. Which paragraphs of liability do they get assessed under in the Education (Student Support) Regulations 2011 (amended) by SLC.

Yours faithfully,

Dear  K. King

Dear Department for Business, Energy and Industrial Strategy,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Business, Energy and Industrial Strategy's handling of my FOI request 'Assessment for non EU family members of UK citizens that exercised treaty rights elsewhere'.

I asked a generic request to The Department for Business, Energry and Industrial Strategy's (DEI); My complaint for internal review is as follow:

1.They responded by stating in their response the account is unmonitored.
2. DEI Asked for me to write them to a private inbox, as they do not want the discussion to be a public space, which defeats the purpose of the Freedom of Information Act.
3. I asked them a simple generic query about which Paragraph would be used for assessment, in The Education Support (amended) 2011, and they have failed to respond accordingly instead they have asked for further information which is not needed in this simple query.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/a...

Yours faithfully,

K.King

FOI Requests, Department for Business, Energy and Industrial Strategy

Dear K. King,

Thank you for your email dated 10/09/2019.

Although you have indicated in your email of 23/08/2019 that you wish to make a request for information, further to your 'right to know' contained in section 1 of the Freedom of Information Act 2000 (FOIA), your email contains an enquiry rather than a request for recorded information held by the Department for Business, Energy and Industrial Strategy (BEIS).

Where a 'request for information' contains an enquiry, rather than a specific request for copies of information held by BEIS, we deal with such requests as a 'normal course of business' enquiry rather than a formal request for information under the FOIA.

Your enquiry was passed to the Department for Education as they are responsible for queries relating to the Education (Student Support) Regulations 2011.

As this is not a matter for BEIS please contact the Department for Education quoting reference 2019-0031643 for information regarding your query.

Kind regards
