In accordance with the Council Asbestos Management Policy and Control of
Asbestos Regulation 2012, an annual inspection should be undertaken in all the schools under the councils control, can you confirm this is the case & also send or link to all the individual schools ‘Site specific Asbestos Management Plans’.

Further to your request for information, I can advise as below;

I can confirm in accordance with the Council Asbestos Management Policy, and Control of Asbestos Regulation 2012, an annual inspection is undertaken in all the schools under the councils control.

The actual management plans specific to each school are exempt from disclosure, please see below.

We have reviewed your request and we consider the information to be exempt from disclosure under s.38 (1) (b) of the Freedom of Information Act 2000. This exemption applies to information that would, or would be likely to endanger the safety of an individual. The Act stipulates that an individual includes any specific individuals, any member of the public, or groups within society.

We have conducted the ‘endangerment test’ under s.38 and believe that disclosure of the requested information is likely to have a detrimental effect on the safety of staff and others who may be affected by such operations. The public interest test is in favour of not disclosing the information requested in order to protect the health and safety of staff and others.

We hope that this information deals with your request, however if you are dissatisfied with the handling of your request, you have the right to ask for an internal review.
