Asbestos Management Policy

We're waiting for Chelsea Barclay to read recent responses and update the status.

Dear Kirklees Borough Council,

I would be most grateful if you would provide me, under the Freedom of Information Act, the following:

The current Asbestos Management Policy used to determine the Management of asbestos within Council owned premises, specifically houses let by Kirklees Borough Council.

Also, any recent amendments to this policy, within the last 12 calendar months.

If this information cannot be provided please provide a clear explanation as to why and how this can be obtained.

I am writing in response to your request dated 22/02/2021.  This has been
dealt with under the Environmental Information Regulations 2004.

 

You asked for the following information:

The current Asbestos Management Policy used to determine the Management of
asbestos within Council owned premises, specifically houses let by
Kirklees Borough Council.

 

Also, any recent amendments to this policy, within the last 12 calendar
months.

 

The Council's response to your specific questions is set out below:

 

466 of the council’s homes for rent are managed on behalf of the council
under a PFI contract.  These homes were built between 2012 & 2014 and do
not contain any asbestos.  The council’s contractor has an asbestos
management plan which would apply if asbestos was brought on to any of the
developments in the contract for example through fly-tipping.  A copy of
the plan is attached.  There have been no amendments to the plan in the
last 12 months.

 

See attached, a copy of the Asbestos Management Policy for KNH managed
properties, as requested. This was published in November 2019 and due for
a review in July 2022. No amendments within the last 12 months.

 

If you are not content with the handling of your request, you have the
right to ask for an internal review.  Requests for internal reviews should
be submitted within 40 working days of the date of receipt of the response
to your original request and should be addressed to the Monitoring

I believe these documents are to be read with each other and form the basis of my FOI request. Could the documents for KNH Control of Asbestos Management Plan please also be attached and again as per my original request any amendments within the last 12 calendar months.

As mentioned in the response neither documents have been amended in the past 12 months. This is stated in the response from KNH which is in red. I have gone back to KNH to request the Control of Asbestos Management Plan, this will be sent over upon receival.

Thank you for the additional documentation.

As with your first response could you please confirm the amendment status of this document? Have there been any amendments in the last 12 months? When is the next scheduled amendment or update due to take place?

Also, could you please confirm this is now everything you have on the policies regarding management of asbestos in domestic households owned by KNH? As KNH are now removing asbestos from vacant properties, yet nothing of this nature is mentioned in any document supplied.

I am writing to request an internal review of Kirklees Borough Council's handling of my FOI request 'Asbestos Management Policy'.

Firstly, when my request was answered I was only given 2 documents one that had to be read in conjunction with another document that wasn't provided. On going back this was provided promptly, which is appreciated, however the information relating to my original request wasn't, such as amendments made within the last 12 months.

Secondly in my first FOI request I asked for the "the current Asbestos Management Policy used to determine the Management of asbestos within Council owned premises, specifically houses let by Kirklees Borough Council". Still after 2 requests all the information hasn't been provided. Kirklees currently work to a number of other asbestos policies that haven't been provided. Particularly polices that decide when asbestos will be removed from said properties, amongst other things. Could you tell me why this is?
