Asbestos in Residential properties managed by Leeds City council

Dear Leeds City Council,

I refer to previous FOI requests dated 3/6/09 (I think your ref Number is 3125?) from Mr A Cairns,
and FOI (your ref) 13054 12/10/14 from Mr S Abid,

Both relate to "Non-Standard Construction &/or Prefabricated Reinforced Concrete (PRC) properties" owned by (or managed by) Leeds City Council.

I am aware that the lists comprises of properties of the following construction types:-

Airey
5M
BISF
Cook
Cornish
Costain
Dorlonco
Gregory Crosswall
Kencast
Laing Guiseley
Laings Easiform
Livett Cartwright
Mowlem
Myton (Newland)
Reema
Riley
Shepherd
Tarran
Terson
Townsen
Trusteel
Unity
Wates
Watling
West
Wimpey H Block
Wimpey High Rise
Wimpey Linear Block
Wimpey No Fines

I am aware that both Livett Cartwright and 5M properties contain Asbestos in various forms, i.e. e.g. Roof tiles, Wall panels, Floor tiles, Chimney stacks and other places.
Therefore
1/ With reference to the above list can you please inform me which of the listed construction types are know to Leeds City Council to contain Asbestos or asbestos related products as part of their construction.
Please include any other residential construction types not mentioned in the above list that may contain asbestos.

2/ For those that contain Asbestos/Asbestos products (as mentioned above), can you please give the postcode of such properties.

3/ For those that contain Asbestos/Asbestos products (as mentioned above) can you list the locations within that style of property where it would be expected to be found. - Copies of Data/information sheets are acceptable.

I write in response to your above Freedom of Information request, received
in this office on 8 August 2019

 

In dealing with your request, please note that we have considered it under
the Environmental Information Regulations 2004, as opposed to under the
Freedom of Information Act 2000. This is because the information you have
requested is information involving ‘activities’ and ‘administrative
measures’ which are likely to affect elements of the environment under Reg
2(1)(c).  I am advised that both the domestic and European courts give
wide meaning to the Regulations and have indicated that they will adopt a
broad construction of the definition of environmental information.

 

Please find the answers to your questions below:

The information you have requested can be found in the attached recently
updated Asbestos Guide Staff Manual that will be made available to all
staff in the coming weeks.

 

I trust that this response is satisfactory. Under Regulation 11, however,
you are entitled to make representations to us if it appears that we have
failed to comply with a requirement of the Regulations in relation to your
request. Representations must be made to us no later than 40 working days
after the date you believe we failed to comply with such a requirement.

 

We will then consider your representations and supporting evidence and
decide if we have complied, notifying you of our decision as soon as
possible, and no later than 40 working days after the date of receipt of
your representations.

 

Under Regulation 18, you are then entitled to apply to the Information
Commissioner for a decision as to whether, in any specified respect, your
request has not been dealt with in accordance with parts 2 and 3 of the
Regulations.
