Arrangement with Instagram as of June 2022
Dear National Crime Agency,
I would like to understand the specific nature of the arrangement between yourselves and Instagram recently announced.
Where did negotiations for this deal take place? How many NCA staff travelled to negotiations, by what means and were any environmentally friendly alternatives considered? How long did negotiations take? What was the total cost to the tax payer of discussions?
Is there physical infrastructure, technology or equipment being imported from the United States and could these not have been sourced here in the UK from local suppliers and manufacturers?
If additional CCTV infrastructure is being constructed, what is the location of these venues? Are any national heritage sites or have any additional technologies been installed at sensitive locations such as Nuclear power plants or endangered wildlife venues?
Does the arrangement involve the data from the United Kingdom being transmitted across international boundaries and outside the EU? By what means and cost especially with regard to carbon footprints.
How many staff have been seconded to this programme and what is the total man hours dedicated by the NCA?
Has the American Partner adequately compensated local residents, communities and institutions for the disruption cause by addition works? What is the specific cost per site and name of the site itself?

Re Environmental Information Regulations request
We write in response to your email to the National Crime Agency dated 20
June 2022. Your email has been forwarded to the Statutory Disclosure Team
(SDT) for consideration.
We have handled your request as a request for environmental information in
accordance with the Environmental Information Regulations 2004 (EIR).
Having assessed your request, we are refusing to disclose information
under Part 3, Regulation 12(4)(c) of the EIR. This allows the public
authority to refuse to disclose information if the request for information
is formulated in too general a manner.
As per Part 3, Paragraph 12(4)(c) of the EIR, the public authority must
comply with Regulation 9. Regulation 9 (2) states that, where a public
authority decides that the applicant has formulated a request in too
general a manner, the public authority shall ask the applicant to provide
more particulars in relation to the request.
At present, the SDT are unsure as to the precise information that you seek
access to. Your request states that you “would like to understand the
specific nature of the arrangement between yourselves [NCA] and Instagram
recently announced”. It is not clear as to how some of the information
requested relates to this subject.
We would therefore ask you to refine and clarify your request in order to
assist the SDT in fully understanding the information you are requesting
under the EIR. The SDT consider each request on a case-by-case basis and
would welcome a more refined and precise request in order that we can
consider the exact nature of the environmental information that you
require under the provisions of the EIR.
Please note, much of the content of this current request would not fall
for consideration under the EIR. This information is not environmental
information and would therefore be treated as a request for information
under the Freedom of Information Act 2000 (FOIA).
The NCA is not listed as a ‘public authority’ in Schedule 1 of the FOIA,
and as such is not obliged to respond to Freedom of Information requests.
The NCA is also not listed as a ‘Scottish public authority’ in Schedule 1
of the Freedom of Information (Scotland) Act 2002.
Any information from, or relating to, the NCA is subject to an absolute
exemption from disclosure by other public authorities by virtue of Section
23 of the Freedom of Information Act 2000 (as amended by the Crime and
Courts Act 2013).
