Dear Kent County Council,

Regarding the stretch of Armco located on the New Dover Road (B2011), CT18, which can be viewed at link:

https://www.google.co.uk/maps/@51.096736...

The Land Register indicates the barrier is situated within property title number K937479 the register describing the land and estate as being ‘land at New Dover Road, Capel Le Ferne, Folkestone.

The Armco appears intended to protect properties, opposite the Valiant Sailor public house. We are informed KCC are well aware of his barrier.

Please provide all information you possess about the land and barrier erected upon same at, to include:

1. when the barrier was installed
2. why the barrier was installed; any requests, complaints, etc.
3. the cost of the installation
4. when the barrier was last inspected/attended upon
5. any reports of incidents at the location since 01/01/2020
6. confirmation of ownership of this barrier
7. your exchanges and considerations about the barrier whether internally or with others (such as local residents); the ownership of the land, the installation of the beams/barrier etc.

Dear Kent County Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Kent County Council's handling of my FOI request 'Armco Ownership and Installation CT18'.

Whilst i thank you for the reply, specifically:

'The armco barrier in reference is not Kent County Council asset and is in a private
domain. As such we do not hold any record of the barrier.'

You have not explained how you have come to this conclusion. Please do so; provide all associated information.

Dear Mr Swift

 

Firstly, please accept my sincere apologies for the delay in acknowledging
receipt of your 23rd March email. The member of staff who this case was
assigned to is in training. She was on leave when you made your comment on
her response and when she returned from leave, she assumed someone else
would have dealt in her absence. Unfortunately, we have only just picked
up your complaint following an audit of outstanding cases that are in
excess of four-weeks old. I can only apologise most sincerely for this
oversight and that as a consequence, we have failed to deal with your
review within the 20-working day recommended timescale.

 

You have challenged Kent County Council's response that it does not hold
any information about the Armco barrier in New Dover Road, and therefore
cannot answer your questions about the barrier. I have doubled checked our
highways records and can only reiterate what we have already told you. The
barrier is on private land, it is not owned by KCC (not a KCC asset) and
was not installed by KCC. I maintain that our original stance, namely we
do not hold information falling within the scope of your request, to be
correct.

 

If you remain unhappy and consider KCC has not complied with legislation,
you can appeal to the Information Commissioner, who oversees compliance
with the Freedom of Information Act 2000 and Environmental Information
Regulations 2004. Details of what you need to do, should you wish to
pursue this course of action, are available from the Information
