Please accept our apologies in the delay in responding to your request.

 

Under Section 22 of the Freedom of Information Act 2000, information is
exempt from disclosure if, at the time we receive a request for it, the
Council is satisfied that the information is intended for future
publication and in all the circumstances it is reasonable to withhold the
information prior to publication.

 

You have requested the Arcadis report on Daedalus which is currently only
in a draft format. The report is currently being finalised and as soon as
it is completed it will be published on the Council's website.

 

The Council is satisfied that Section 22 of the Act therefore applies.
S.22 is subject to a public interest test. The Council has considered the
Public Interest test in response to your request and has concluded that
the public interest test favours non-disclosure of the information you
have requested at this time for the reasons set out below.

 

It is feasible that early site of the draft document, however incomplete,
may assist you in understanding how the early consultation draft has been
arrived at and assist in public transparency and accountability in
decision making terms by aiding your formulation of your response to the
proposed application.

 

However it is considered that early release of the incomplete document
would be potentially misleading and prejudicial to the ongoing
consideration of the submitted planning application. The report that you
have requested is anticipated to be published with the next few weeks. It
is therefore considered that the harm in releasing early potentially
misleading information far exceeds the benefits that would be gained in
terms of public understanding of the proposal.

 

I am sorry that we have not been able to release the information you have
requested but I trust that the explanations as set out above, provide you
with a full reasoning for the non-disclosure at this time.

Thank you for your reply and web link today's date.
Above clause 27. is an extract regarding Section 22 from the Information Commissioner's Office's website. With that guidance in mind, now that the final draft has been published, please supply previous drafts of the 'Arcadis Report', as well as that it was supplied 'in other document.'
I look forward to receiving this information for various reasons, not least to achieve further clarification of the Report as supplied, but better understanding, public transparency and accountability. All extremely important as you will appreciate.

Dear FOI,
Under any circumstances I believe Fareham Council's reply to me is unacceptable and I find is proving obstructive to the point of quite possibly being legally prejudicial to me. That is because on the 23 January 2016 Fareham Council's Planning Meeting will be held at which determination will be made by Fareham Council upon the subject matter of the Arcadis Report in which I have an interest: planning application no. P/16/0557/OA regarding the massive transformer, connector, undersea cabling etc at the 2 disparate sites of Daedalus and Chilling. Therefore I am lodging a formal complaint with Information Commissioner's Office.
To remind my original request was dated 3 November 2016. Council then treated that request as a fresh request. Generous counting of 20 days brings my request as due of information which readily exists.

Clearly my 4 February 2017 email is not a new request, it seeks clarification of Council's response. Therefore, I look forward to receiving clarification before the date of 24 February you give.
Furthermore, I believe it unacceptable that:-
a) Council appears to either treat my asking for clarification as a further FOI, or
b) is unacceptably adding a further 20 day timescale in which to respond which given past performance Council would appear likely to fully utilize. Perhaps Council should remind itself of the content of the Information Commissioner's Office recent communication to Council following my complaint regarding the time Council absorbs before making responses.
