Request for Information - Freedom of Information Act 2000 (FOIA)

 

Further to your recent request for information under the Freedom of
Information Act received on 28 September 2017, I am able to supply the
following information on behalf of Bury Council.

Please provide a copy of the protocols and procedures which you have in
place, via your Youth Offending Team or otherwise, which are relevant to
your provision of Appropriate Adults.

Please find attached document that details the relevant parts of the
contract in relation to this FOI.

 

These protocols and procedures will include the data which is to be
collected by the Appropriate Adult on your behalf.  Please also state how
the collection, and processing of this data, complies with the
requirements of the Data Protection Act 1998 – and how you ensure that
these requirements are complied with.

Bury are part of a Greater Manchester-wide contract to ensure consistency
across the conurbation.  The responsibility for the management and
training of the Appropriate Adults rests with the contractor within the
terms of the schedule attached.  These would have been presented and
agreed at the regular contract review meetings.  Also the regular contract
review meetings would address any breaches including data protection. 
Between contract review meetings the contractor is required to notify the
council immediately of any significant problems including data protection
breaches.

I am writing to request an internal review of Bury Metropolitan Borough Council's handling of my FOI request 'Appropriate Adults'.

I am surprised and disappointed by your response. You, Bury Metropolitan Borough Council, are legally responsible for the provision of Appropriate Adults for juveniles. I do not accept that you can just say that you have subcontracted this matter to a third party.

I would hope that Bury Metropolitan Borough Council do have procedures and protocols in place for the provision of Appropriate Adults – even if that service is provided by a third party.

Please provide copies of all such protocols and procedures which are in your possession – which enable you to fulfil your legal obligations – or please clearly state that you do not possess any such documents.

Please provide a copy of all your instructions to the third party which enables you to fulfil your legal obligation, including any forms which the third party complete on your behalf.
