Application of the Indemnity principle on behalf of members of the City Council

Dear Liverpool City Council,

On 29th November 2012 the Council's Chief Executive made an executive decision to apply the Indemnity principle to cover the legal costs of the Mayor's industrial tribunal claim.

Please disclose the reports or records of previous decisions to apply the Indemnity principle in support of members (not officers) of the City Council.

Please provide either the ten most recent occurrences of the use of the Indemnity or all occurrences after 31 December 1995, whichever is the fewer.

Dear Liverpool City Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Liverpool City Council's handling of my FOI request 'Application of the Indemnity principle on behalf of members of the City Council'.

The response is seriously overdue. Records of the previous use of the indemnity principle, if any, should be readily available to the City Council, given the assertion that the exercise of the indemnity in favour of the Mayor's legal fees was not unusual and in line with previous uses of the indemnity principle by the Council.

Thank you for the response. You have provided some of the information, but not the actual decision reports on the two instances.

Can you at least provide
(1) the dates of each of the two decisions; and
(2) confirm whether each instance was a defence by a member against an action rather than an action initiated by or on behalf of the member.

However, as you have asked for confirmation and not information in regards to point 2 this does not fall under the remit of the Freedom of Information Act 2000 and, as such, I cannot assist in this matter

I see that the Indemnity Principle had not been used in relation to employment before Anderson came along.........still waiting for Fitzgerald and the City solicitor to respond to my email and attachments!
