Dear FOI,

Thank you for your prompt reply to my enquiry, which has provided the opportunity to refine my request somewhat..

In response to your questions:

i) Do you require injury RTC’s, Damage only RTC’s or
both?
If it is possible within your time budget to provide both separately, that would be most useful, thank you.

ii) Do you require this information in Financial or Calendar
years?
Calendar years would be best for my purpose, providing that 2019 can be included. The information is not required before January 2020.

Yours sincerely,

Chris Holbrook

SWYDDOGOL OFFICIAL

Dear Sir/Madam,

FOI Reference: 1038/2019

I write in respect to your request for information dated and received
within the Freedom of Information Unit on the 19^th December 2019
regarding RTC’s and use of mobile phones.

Your request for information has been handled under the Freedom of
Information Act 2000 and has now been considered.

Section 1 of the Freedom of Information Act 2000 places two duties on
public authorities. Unless exemptions apply, the first duty at Section
1(1) (a) is to confirm or deny whether the information specified in a
request is held. The second duty at Section 1(1) (b) is to disclose
information that has been confirmed as being held.

Dyfed-Powys Police are unable to confirm or deny whether it does hold the
information you have requested, since we consider that the Section 12(2)
exemption the Cost of Compliance exceeds the Appropriate Limit applies to
it.

Where exemptions are relied upon Section 17 of the Freedom of Information
Act 2000 requires Dyfed-Powys Police, when refusing to provide such
information (because the information is exempt) to provide you the
applicant with a notice which:

(a) states that fact,

(b) specifies the exemption in question and

(c) states (if that would not otherwise be apparent) why the exemption
applies.

Please see the attached response document which indicates the time
estimated by the Force it would take to complete the request as a whole.

In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice for the whole of this request under Section 17(5) A
public authority which, in relation to any request for information, is
relying on a claim that section 12 or section 14 applies must, within the
time for complying with section 1(1), give the applicant a notice stating
that fact. You may wish to refine and resubmit your request so that it
reduces the time shown above to fall within the 18 hours, however with due
regard to the time estimate provided above it is unlikely that refining
your request will fall under the 18 hours as the same method and format
will have to be undertaken. Should you require any further advice in
relation to this matter please don’t hesitate to contact the Freedom of
Information Unit.

Please also be advised that should the request be refined, it does not
remove the public authorities right to cite exemptions if relevant.

Although excess cost removed the force’s obligations under the Freedom of
Information Act, as a gesture of goodwill, I have supplied information,
relative to your request, retrieved or available before it was realised
that the fees limit would be exceeded - please see the attached response
document.

If you are unhappy with the way your request for information has been
handled, you can request a review by writing to the Freedom of Information
Unit address supplied on the attached appeal process document.

If you remain dissatisfied with the handling of your request or complaint
you have a right to appeal to the Information Commissioner at:

The Information Commissioners Office,

Wycliffe House,

Water Lane,

Wilmslow,

Cheshire

SK9 5AF

Tel. 0303 123 1113 or 01625 54 57 45

Website: [1]www.ico.gov.uk

There is no charge for making an appeal.

Should you wish to discuss this matter further please don’t hesitate to
contact me as indicated below.

I would also like to take this opportunity to thank you for your interest
in Dyfed-Powys Police.

Yours sincerely

Nicola Barresi

you are still dissatisfied, then you have the right to direct your

Dear Dyfed Powys Police,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Dyfed Powys Police's handling of my FOI request 'Annual statistics regarding use of mobile phones by drivers involved in traffic accidents'.

Based upon my many years of experience of information systems, I consider that your calculation of the effort involved in responding to my request is probably flawed, and invite you to re-examine your methodology and time estimates.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/a...

Yours faithfully,

Chris Holbrook
