Dear Leila,
Thank you for your information request dated 22^nd February 2019. We
sincerely apologise for the delay in responding.
We have considered your request in line with the Freedom of Information
Act 2000.
Response
Please find below the figures of sexual assault for each financial year
(1^st April – 31^st March).
Year 2014/15 2015/16 2016/17 2017/18 2018/19
Sexual
Assault 28 23 36 31 30
This is the only data we are able to supply where a member of staff (over
18) has been sexually assaulted, by a patient or a member of the public.
The majority of incidents involved unwanted touching or grabbing of staff
by patients, not including physical violence in the form of punches,
kicking etc. We are unable to confirm whether allegations are routinely
referred to the police.
We believe complying with the remaining of your request will exceed the
appropriate limit under section 12 of the FOIA. This is because further
details relating to your request would include reading through each
individual incident in response to the information requested. We are
therefore refusing to disclose further information as we believe it
exceeds the appropriate limit of £450 required to identify and provide all
information as part of this request in line with the Freedom of
Information and Data Protection (Appropriate Limit and Fees) Regulation
2004.
Therefore in order to provide the level of detail requested, we will have
to carry out a manual search of over 100 cases to extract further
information, which we estimate will take us over the required 2.5 working
days. You may wish to refine your request by narrowing its scope.
Although we are unable to guarantee that any refined requests would fall
within the cost limit.
I hope my email is useful. If you believe I have made an error in the way
I have processed your information request, it is open for you to request
an internal review. You can do this by emailing us. You will need to
specify the nature of the issue and we can consider the matter further.
Beyond that, it is open to you to complain to the Information
Commissioner’s Officer ([1]www.ico.org.uk).
Yours sincerely,
