Regulations (EIR) 2004. We can confirm that Buckinghamshire Council does
hold information falling within the description specified in your request.

Your Request:

I request copies of all reports, documents and correspondence relating to
pre planning app. 21/01601/COMM relating to Flannery request for site of a
construction machinery training facility.

 

Our Response:

Please see the attached documents. We have redacted personal data in
accordance with regulations 12(3) and 13 of the EIR.

 

Furthermore, please note that we are withholding a small amount of emails
and part of document 3 under Regulation 12(4)(e) of the Environmental
Information Regulations as they are internal communications. When applying
this exception, we have to consider the public interest test. We recognise
that there will always be some public interest in disclosure to promote
transparency and accountability of public authorities, greater public
awareness and understanding of environmental matters, a free exchange of
views, and more effective public participation in environmental decision
making, all of which ultimately contribute to a better environment.

 

However, it is also recognised that a public authority needs a safe space
to develop ideas, debate live issues, and reach decisions away from
external interference and distraction. Furthermore, disclosure of certain
internal discussions would inhibit free and frank discussions in the
future. This loss of frankness and candour would damage the quality of
advice exchanged between colleagues and could lead to poorer decision
making. We consider that the factors in favour of maintaining the
exception outweigh those in favour of disclosure.
