Dear Mr Hussain,

 

I refer to your request dated 19 September 2023 under the Freedom of
Information Act asking to supply the following information:

 

“I would like the name, registration SWID number and date last employed at
Bradford Council, of all Social Workers NOT included in the recently
published list by Social Work England of even date regarding  1,062
individuals you presently employ as registered Social Workers in
Bradford.  I am only interested in those Social Workers who are no longer
working with Bradford Council but were once employed by you”.

The Council’s response is set out below:

 

The Council are withholding the information requested as it contains
wholly personal information relating to persons other than yourself, the
applicant. Section 40(2) & (3A) of the Freedom of Information (FOI) Act
2000 provides an absolute exemption where disclosure of information would
lead to a breach of the principles laid down by the Data Protection Act
2018.

 

I consider the disclosure of the information which you have requested
would constitute unfair processing in contravention of the first data
protection principle because those individuals whose personal data has
been withheld would not have had any reasonable expectation that it would
be disclosed in these circumstances.  Therefore, this response acts as a
refusal notice under Section 17(1) of the Freedom of Information Act in
accordance with Section 40(2) & (3A) of the Act.

 

In accordance with the Freedom of Information Act, if you are not
satisfied with the reply to your request you can ask for an internal
review. A request for an internal review must be submitted within 40
working days in writing to the Corporate Information Governance Team, City
of Bradford Metropolitan District Council, City Hall, Centenary Square,

This list does not include previous social workers employed at the Council, such as Anne Bateson and Esther Leigh-Solaru whom I have had personal dealings with. Any such list now being provided should include these two named individual at a minimum.

Dear ICO - Paula Flanagan,

I write to lodge a new complaint to yourself as the Information Commissioner's Office (ICO) regarding the City of Bradford Metropolitan District Council's (CBMDC) handling of my FOI request via the WhatDoTheyKnow website. See the following :

After having provided the Council with a named list of present Social Workers employed at the Council, I request a list of all previous Social Workers employed with them. They refuse, citing personal information. I don't believe this is correct.

The problem with failing to provide this information can be deemed as an avenue for injustice to occur and a conflict of interest to arise under the following scenario or circumstances:

The Local Authority may look to instigate Court of Protection (CoP) litigation proceeds against a resident they serve. As part of such proceedings, they would require an independent Social Worker to carry out an independent Mental Capacity Assessment for the purposes of the Court proceedings. It would clearly be a conflict of interest if a social worker presently employed at the Council were to carry out such an assessment, for the purposes and to the benefit of their employer, the Council. However, the same conflict of interest arises if a social worker leaves the Council and becomes an independent trader in the private sector or joins another Council and is then relied on for such an "independent" assessment as part of Court proceedings.

If the current Social Worker's status as employed with the Council can be determined then so should the status of former social workers. Even former Social Workers who have retired from the profession do not have a right to be "forgotten" as their name still remains listed on the public register of Social Work England. I believe the use of section 40 by the Council now is overly excessive and I would like you the ICO to investigate this complaint to establish if the Council's reliance on section 40 is both correct, proper and appropriate.
