In response to your request for information received at this office on 04
February 2019, please see Bolton Councils response below.

 

You requested

 

Can you please provide the following details from the records which you
hold under The Licensing Act 2003:-

Our response

 

Bolton Council has considered your request and feels that part of the
information you request is exempt from disclosure under the Freedom of
Information Act 2000 (“the Act”).  Section 17 of the Act provides that
when refusing a request, Bolton Council must provide a notice which (a)
states that fact, (b) specifies the exemption in question, and (c) states
(if that would not otherwise be apparent) why the exemption applies.

 

You will note that some information has been redacted using xxxxx.  We
consider the Designated Premises Supervisors Name, address and postcode,
personal addresses of premises licence holders and personal telephone
numbers are exempt under Section 40(2)(a) Disclosure of the information to
a member of the public otherwise than under FOIA would contravene: any of
the data protection principles. The information you are requesting is the
personal data of a third party.  Whilst I can confirm we do hold this
information to release their information would breach Part 1 Section 2a of
the Data Protection Act 2018 which states:-

 

(1) The GDPR, the applied GDPR and this Act protect individuals with
regard to the processing of personal data, in particular by -

 a. requiring personal data to be processed lawfully and fairly, on the
basis of the data subject’s consent or another specified basis

 

Therefore to release the information to you would be unlawful, unfair and
without consent and therefore would breach this part of the DPA 2018 thus
making the information exempt from disclosure under Section 40(2)(a). This
constitutes a refusal notice for this part of your request.

 

Section 21(1) provides an exemption where the information is reasonably
sought by other means.  Numbers of premises are reasonably accessible via
other means as they can be searched either by telephone book or via
internet search and therefore we consider Section 21(1) of the Act applies
to this part of your request. In accordance with the Act, this constitutes
a refusal notice for this part of your request.

is not held. we do not have a report which categorises each premises only
by type of licence which is in column H.

exempt as detailed above

• Premises Telephone Number – exempt see above

• Premises Licence Holder Postcode – see column K some information is
exempt as detailed above

• Designated Premises Supervisor Name – exempt see above

• Designated Premises Supervisor Address – exempt see above

• Designated Premises Supervisor Postcode – exempt see above
