The Trust has received the e-mail request below under the Freedom of
Information Act (Our Ref  2667).

 

The Act allows anyone the right to request any information held by a
public authority, including Minutes, reports and emails.  The Trust must
provide the requested information within 20 working days.   Please advise
me immediately if you or your department do not hold the information
requested.  Otherwise, I would be grateful if you could arrange to forward
the information to me at [1][Airedale NHS Foundation Trust request email]  no later than 8^th March
2017.

 

There are some Exemptions from disclosure under the Act.

·      Some exemptions are “absolute” e.g. personal information, or when
the information is already reasonably accessible by other means, e.g. on
our Trust or other official website. 

·      Some exemptions are “qualified”, applying only where the public
interest in maintaining the exemption, outweighs that of providing the
information. 

·      In addition, if identifying, retrieving and processing the
requested information requires more time than the appropriate “cost
limit”, we may refuse the request.  The “cost limit” represents one person
working 2.5 days to determine whether the department holds the information
and to locate, retrieve and extract it. 

 

We also have a duty to “advise and assist” the enquirer, which includes
giving advice on whether a refused request could be modified, to enable
the Trust to provide some of the information being sought. Further

Please notify me as soon as possible, with an outline of your concerns, if
you feel the information sought in this request may be exempt from
disclosure. If you require any advice or assistance to deal with this

The Information Commissioner (ICO) is now monitoring public authorities to
ensure that they are meeting their legal obligations under the FOI Act.   
Action will be taken against authorities repeatedly failing to meet the
appropriate timescales.
