This request relates to TM44 Air Conditioning Inspection Reporting, which is mandatory for buildings which are air conditioned above a statutory minimum size. Ministry of Housing, Communities and Local Government has recently taken over compliance.

Q. Who is the responsible person for ensuring that your buildings are legally compliant on the TM44 requirement? Provide the name, position, address, email address and direct telephone number of the responsible person.
Q. All reports are mandatorily lodged on the MHCLG database. No reports are currently lodged or are out of date, you are therefore non-compliant. When do you intend to rectify the situation?
Q. Air conditioning and air handling systems can cause increased risk of Covid-19 spread, have you included the TM44 into your return to work risk assessments?
Q. If you use a Facilities Management Company to manage compliance, who are they?

Dear requester,

We have noted your FOI request, but before we take it forward we want to confirm with you that you actually are aware of what and who we are, and how our data actually might not be of much value to you, and could even adversely affect your data-set.

We are the smallest unitary authority in England and Wales. We are a small group of islands 28 miles off the coast of Cornwall, with a population of around 2,400 people.

We do have the mechanisms of a unitary authority though, but obviously on a much smaller scale than other local authorities, and we even run additional services like an airport, and as of 1 April 2020 our water and sewerage provision changed when it came under the control of South West Water.

Here are some facts that may help with your enquiry:

We have no local authority-run schools here, only the Five Islands Academy
We have no kennels.
We have no zoos
We have three ‘A’ roads, in total 12 miles of roads
We have no high-rise buildings (max 4 stories)
We have no local authority bus service
We have no taxi licensing
We have no casinos
We have no nightclubs
We have no car parks or parking spaces from which we collect fees or charges
We have no parking inspectors
We have one local authority care home
We have no assets of community value

Our Council officers are busy and have small teams, and this also is true of the FOI department where we field enquiries every day, some of which are obviously national circulars to all local authorities, but sometimes our data is not of use to them due to our obviously unique situation, which they may not have been aware of at the time of sending their request.

Also bear in mind that the Covid 19 pandemic is still affecting our ability to get FOIs completed on time, and that your request may take slightly longer than the statutory deadline.

Much of the local authority is still operating from home currently, and our Council meetings have been taking place virtually. So far there have been no recorded cases of Covid 19 on the islands, though this can change at any time.
