Dear East Sussex College Group,
This request relates to UK Environmental Legislation, specifically Air Conditioning Inspection Reporting, which is mandatory for UK buildings which are air conditioned above a statutory minimum size.

Q. How many buildings do you occupy which have air conditioning. Provide addresses?
Q. Who is the responsible person for ensuring that your buildings are legally compliant on this mandatory environmental matter? Provide the name, position, address, email address and direct telephone number of the responsible person.
Q. All reports are mandatorily lodged on a Government database. No reports are currently lodged or are out of date, you are therefore non-compliant. Has your Governing Body been made aware of this breach?
Q. Provide the name and email address of the ultimate person who has made the decision to ignore this Environmental Legislation.
Q. Provide the name and email address of the Board Principal/Director of the College.
Q. If you use a Facilities Management Company to manage compliance, who are they?

In response to your question regarding :

I have checked the Government database where all TM44 Air Conditioning Certificates and Reports are lodged , there are none showing for the postcode BN21 2UF.
If you have any buildings which contain Air Conditioning Units over 12kw , then a TM44 should be held on the Government Database to remain compliant.

Q. How many buildings do you occupy which have air conditioning. Provide addresses?
All of our sites and buildings in Hastings, Eastbourne and Lewes have various sizes of air conditioning units from below 12kw up to 340kw. The addresses of those facilities can be found on our website.

Q. All reports are mandatorily lodged on a Government database. No reports are currently lodged or are out of date, you are therefore non-compliant. Has your Governing Body been made aware of this breach?
In accordance with the Department of Education (DfE) requirements, E-mandate reports have been completed yearly however, actual efficiency reports have not been actioned as a result of the condition of the facilities the group inherited at merger. The College has engaged a consultant/contractor to evaluate this work and to agree a detailed scope of reports.

Q. Provide the name and email address of the ultimate person who has made the decision to ignore this Environmental Legislation.
The legislation has not been ignored and we would respectfully request that you avoid making vexatious remarks and comments of this nature. For your information, at the point of merger in March 2018, the College inherited a range of legacy M&E systems across the Group and a focus of the team has been to put in place much needed and essential planned preventative maintenance of all plant which is now in place. Over 50% of our buildings are considered by the DfE to be in a category condition 'C' and/or 'D' and a major cornerstone of the Group's current estates strategy is to replace those buildings with new and/or refurbished facilities. In turn this will ensure compliance with all relevant and current legislation.

The College doesn't use a single integrated facilities management company but engages a range of specialist contractors specifically for this work.
