Dear Bourne End Academy,

This request relates to UK Environmental Legislation, specifically Air Conditioning Inspection Reporting, which is mandatory for UK buildings which are air conditioned above a statutory minimum size.

Q. How many buildings do you occupy which have air conditioning. Provide addresses?
Q. Who is the responsible person for ensuring that your buildings are legally compliant on this mandatory environmental matter? Provide the name, position, address, email address and direct telephone number of the responsible person.
Q. All reports are mandatorily lodged on a Government database. No reports are currently lodged or are out of date, you are therefore non-compliant. Has your Governing Body been made aware of this breach?
Q. Provide the name and email address of the ultimate person who has made the decision to ignore this Environmental Legislation.
Q. Provide the name and email address of the Board Principal/Director of the Organisation.
Q. If you use a Facilities Management Company to manage compliance, who are they?

Please respond to our FOI or advise why we have not yet had a response. Legally, Public Authorities must respond within 20 working days.
It is clear that you are flouting Environmental Legislation by not complying with statutory reporting, and not lodging compliant reports on the Government Database (a Public Record).
Please be aware that your responses (or lack of) will be forwarded to Government Environment Departments and other interested Environmental Groups.

Dear Mr Jones
I have been passed your chaser on the FOI request relating to "Air
Conditioning Inspection Report Environmental Compliance Audit (commonly
known as an ACI TM44)" at Bourne End academy.  I apologise that you have
not yet had a reply to your request, but it has now been logged with the
above reference number.
In order to expedite matters, please could you send me a copy of your
original request, and confirm which academies your request relates to, if
you have sent it to more than one academy.  Please note, that should you
wish to send us FOIs in the future, this is the email address to use as
FOIs are managed centrally.
You state the FOI was sent on 24 October; the due date would have been 29
November 2019 as educational establishments do not count school holiday
closures as working days under the Act.  In the circumstances, I would be
grateful if you would agree to a short extension to the submission of this
FOI; would that be okay with you?  We will of course endeavour to meet to
original deadline.

In regards to the other Academies within your trust , every building which has air conditioning of 12kw and over should also have a compliance report and certificate in place .

Thank you for your reply, our responses are below.  As you contacted
Bourne End and City Heights, we have replied for the London region:

 

Q. How many buildings do you occupy which have air conditioning. 

 

In the London and Bucks region E-ACT has a total of six academies.  The
details and location of each can be found on our website [1]here

 

Each academy has a dedicated facility manager, who have confirmed the
make, model and loadings for the AHU/AC units in their respective
academies.  Consequently E-ACT has three academies in the region
that exceed a combined effective rated output of more than 12kW: 

 

o Bourne End E-ACT Academy
o City Heights E-ACT Academy
o The Crest E-ACT Academy

Q. Who is the responsible person for ensuring that your buildings are
legally compliant on this mandatory environmental matter? Provide the
name, position, address, email address and direct telephone number of the
responsible person.

 

Chris Wiseman, Chief Operating Officer and Deputy CEO.  He can be

Q. All reports are mandatorily lodged on a Government database. No reports

Has your Governing Body been made aware of this breach? 

 

E-ACT Facility Managers confirm that all installations are regularly
serviced but acknowledge that data has yet to be logged onto the
Government database.  We are currently in the process of commissioning
independent consultants to undertake the TM44 inspections who will upload
the appropriate data in due course.  Our Deputy Chief Executive is being
kept informed of the situation.

No decision has been made to ignore the TM44 regulations inspection of air
conditioning systems in E-ACT academies.

All aspects of Facilities Management are managed and delivered by
site-based teams and supported by Regional Facilities Management staff. 
All staff within the E-ACT Facilities Management teams are employed by
E-ACT.
