I am writing to clarify/amend a part of my information request,Section 1.2, with regards payscale information.

This part of my original request stated:

Please also add after the word 'framework':

If you do you use a Managed Service Provider please also provide a copy of the pay-scales/rates that are used by the Managed Service Provider to manage all these Vendors.

Therefore section 1.2 should now read thus:

Dear Mr Blair

I was very disappointed to see that we had not been able to meet your Freedom of Information request dated 8th February 2009 regarding "Agency worker: Agreements, contracts, pay scales" within the prescribed timescales.

Upon investigation, I'm sorry to say, that this was due to an unusual set of specific circumstances regarding our staffing that resulted in you FOI request being overlooked. We have introduced new procedures that will ensure that these occurrences do not happen in the future.

Please find attached copies of the current agency worker contracts that we have in place as part of the London Contract & Supplies Group, the associated hourly rates and the suppliers to our contracted agencies.

You will notice that the Eden Brown (Matrix) contract has had the Target Margin Column in Schedule 3 blanked out pursuant to section 43(2) of the FOI Act in that its disclosure would be likely to prejudice the commercial interest of both Eden Brown/Matrix and the Council.

Once again please accept my apologies for the delay in responding to your original request and also my assurances that remedial action has taken place.

The info commission says "A public authority which believes that the commercial interests of a third party will, or are likely to, be prejudiced must explain why this is the case". and also "Even if information falls within section 43, public authorities must then apply the public interest test set out in section 2(2)(b). The information can only be withheld if the public interest in maintaining the exemption outweighs the public interest in disclosure"
