1) What was the value of spend on temporary staff from recruitment agencies
by the Council in 2020 – 2021 and 2021 – 2022?

Please also ensure that a gross spend value is detailed and include all spend associated to any contract let for the management/provision of temporary staff by a contracted provider (whether Vendor neutral or Master vendor). Please ensure that all figures are provided separately by year.

2) If you have a managed service provider (MSP) in place for the provision
of temporary agency staff, please provide the following;
a. How was the contract to manage/provide the supply of agency/temporary staff let?

b. Who was the contract to manage/provide the supply of agency/temporary
staff let to?

c. When did the contract to manage / provide the supply of temporary /
agency staff commence, how long does it run for and what is the end date?

I am writing to request an internal review of East Dunbartonshire Council's handling of my FOI request 'Agency Staffing Agreement'.

I note that you have not confirmed or denied whether the authority holds this information, and have not applied an exemption that would remove this obligation.
As you may be aware, Section 1(1) of the FOI Act (https://www.legislation.gov.uk/ukpga/200...) states that "Any person making a request for information to a public authority is entitled to be informed in writing by the public authority whether it holds information of the description specified in the request".

I write in response to your request that East Dunbartonshire Council carry
out an internal Review of your Freedom of Information enquiry on the above
subject. I can confirm that I am an officer who was not involved in dealing
with your original request.

I find that, in dealing with your request, was not processed in accordance
with the requirements of Part 1 of the Freedom of Information (Scotland)
Act 2002/ the Environmental Information (Scotland) Regulations 2004, in
that the formal response was not sent to you within 20 working days of the
Council receiving your request. I understand this was due to unprecedented
demands on the team at that time.

As you have expressed your dissatisfaction with the response I must now
reassess the Council's answer to your enquiry.

Your original request for information sought to establish ?If you have a
managed service provider (MSP) in place for the provision of temporary
agency staff, please provide the following? with then a series of questions
being asked. In replying to this question the Council responded with an
indication of ?N/A?. In doing so the response wished to convey that this
question was ?not applicable? meaning that the Council did not have a
managed service provider. The relevant exemption in such circumstances
would be Section 17(1) with the response a more complete articulation of
the Council?s position being as follows.

The Council does not have a managed service provider and therefore under
Section 17 (1) of the Freedom of Information (Scotland) Act 2002, I must
inform you that the Council does not hold the information you have
requested.

I trust this is sufficient to finalise your request however please do feel
free to contact me if I can clarify any part of the above.

If you remain dissatisfied with the Council's response to your request for
review you are entitled under Section 47(1) of the Act to apply to the
Scottish Information Commissioner for a decision as to why your Freedom of
Information request has not been dealt with in accordance with Part 1 of
the Act. Your application must be in writing or some other permanent form
which can be used for subsequent reference and must be submitted before the
expiry of six months after the date of your receipt of this letter/message.
