Affordable housing occupancy rates
Dear Dales Housing,
I would like to request from you the current and historical occupancy rates for affordable housing in the Derbyshire Dales for the last 5 years, broken down by development.

Thank you for your request under the Freedom of Information Act 2000.
As Dales Housing is not a public company or government authority it is not
subject to FoI rules and so we will not be inclined to provide the
information you have requested. As we are not the only social housing
provider with properties in the Derbyshire Dales area we wouldn't be able
to provide a complete and exhaustive response.

Obviously, I am disappointed in your refusal to provide this information.
I'd like to ask you if your association is a member of the Housing Corporation, and if it follows the Housing Corporation's guidelines on providing information that it holds.
I provide a quote from the Housing Corporation's website about access to information:
"The Housing Corporation requires housing associations to be accessible, accountable and transparent to residents and other stakeholders. The National Housing Federation Code of Governance states that associations should operate in an open and accountable manner by generally making information about their work available to their residents, local communities and other stakeholders."
It would appear that whilst you don't have a legally-binding FOI law governing disclosing information, the Housing Corporation's own standards point to a stance that, if followed, should enable you to provide the information I requested.

I can confirm that Dales Housing is regulated by the Homes and Communities
Agency (which took over from the Housing Corporation in 2008).
I regret that Dales Housing is unable to provide you with the information
you requested, as mentioned by Chris, we are not subject to the Freedom of
Information Act 2000.
