You recently wrote to my colleague Noel Usuanlele concerning a Freedom of
Information Request that you submitted to Lambeth Council in the summer of
2009 which remains unresolved.Your original questions (as quoted below):-
How many social workers are there working in adult care? How many of these
are working with disabled people under 60? How many adults are you
providing some sort of community care service to in total?
How many allocated cases are there in adult care? How many unallocated
cases are there in adult care? How many `held' cases are there in adult
care. What is the ratio of adult care cases to each social worker. What is
the average time between referral for a service and assessment of needs
What is the average time between referral and provision of the necessary
service. What is your total adult care budget for 2009-2010 What

I have been asked to write to you explaining the council's position on
this.
My understanding is that Mr Usuanele, in accordance with our duty under
Section 16 of the FOI Act to provide advice and assistance, wrote to you
seeking clarification of your question soon after it was received.
This was because your question was capable of more than one interpretation
and, in the absence of clarity, any answer provided would be based on an
assumed interpretation which might be wrong. Your request was consequently
suspended, with the clock stopped pending receipt of your clarification.
Mr Usuanele received no immediate answer from you and when you
subsequently wrote to him asking about progress you did not include in
your message the clarification that had been sought. Section 1(3) of the
FOI Act allows requests to be disregarded in such circumstances provided
that we have fulfilled our duty to inform you of what further information
we require (as quoted below):-.
Please could you clarify if you want figures for both permanent and agency workers? Please note that our social workers work with people across the age group you specified, that is adult social care workers that manage people under 60 also manage above 60.
It has recently come to our attention that you have posted an "annotation"
on the "whatdotheyknow" website. However public authorities are under no
statutory obligation to proactively monitor postings on third party
websites such as "whatdotheyknow" in connection with FOI requests. Whilst
your intended message may well offer the clarification that we seek, it
has not been formally communicated directly to the council and in terms of
the law has thus not yet been received by us. If you wish to proceed with
the request then you should repeat it in an email to our FOI mailbox
[1][Lambeth Borough Council request email] (which I monitor) or to me personally at
[2][email address] or to Mr Usuanele [3][email address]
in order for us to technically receive it. Only then can the request be
formally considered under the legislation.
