Please undertake an interval review as this is not I believe a proper response.
Thank you for this - i understand you have forwarded this to what you describe as your service provider and accordingly it is *closed* . How do you expect the provider to deal with this request unless they can access this system.
Secondly as the Council is responsible then why are you unable to reply to this?
Thirdly, can your legal team confirm that your ‘provider’ is subject to Foi?

Please take legal advice on this response as if you refuse to answer, then there’s needs to be a proper rationale.. not I’m passing on, end of.

Please accept my apologies for the delay in responding to your email of
10/12/2019. Your questions and my answers are as follows:

 

o I understand you have forwarded this to what you describe as your
service provider and accordingly it is *closed* . How do you expect
the provider to deal with this request unless they can access this
system.
The information you have requested below is not held by the Royal
Borough of Windsor and Maidenhead. All children's records are held by
Achieving for Children (AfC), who are a not for profit social
enterprise organisation that delivers children's services on behalf of
Windsor and Maidenhead. Your request is closed with RBWM but will be
open with AfC.

 

o Secondly as the Council is responsible then why are you unable to

We are unable to respond to your request because we do not hold the
information you require. AfC hold this information and they have the
obligation to process your information request.

AfC are subject to the requirements of the Freedom of Information Act
2000

RBWM are not refusing to answer your request. We do not hold the
information you require. We have passed it to AfC who are responsible
for Children’s services for RBWM.
AfC must respond within 20 working days of the date of receipt. I
would have expected you to have received an acknowledgement from them
and a full response within 20 working days, no later than 15^th
January 2020.

 

I have copied in the foi team at AfC so that they can confirm when they
received the request and update you on the progress of it.

 

Please let me know if AfC do not update you and I will contact them on
your behalf.

Response
1. Achieving for Children is planning to undertake a 'Lessons Learnt'
Review that will include examining the policies that are being used in our
name. The relevant policies, however, are those of the Regional Adoption
Agency, Adopt Thames Valley and we will continue to work closely with
them. 
2. Adopt Thames Valley have not made any policy changes.

3. Please refer to the attached briefing note that was shared with the
cabinet in October 2019.  There will be subsequent related information
available, however, the work has not yet been completed.
