For the avoidance of doubt, this includes all venue locations, facilities, attribute values, clubs, and individuals that have elected to disclose their public information.

Please make this information available in its current electronic format (e.g. a single database file), or in individual tables output from it, disclosing all data.

Active Places Cymru website.  I can confirm that Sport Wales holds this
data.

 

All data used in Active Places is published on the Active Places Cymru
website at:

We are therefore claiming an exemption under Section 21 of the Freedom of
Information Act.  This states that a public authority does not need to
provide information under Section 1 of the Act if that information is
reasonably accessible to the applicant by other means.  It is important to
note that Section 21 is not subject to the public interest test; if the
information requested is accessible to the applicant by other means then
it is exempt.

Dear John,

Thank you for your prompt reply to my FOI request.

Unfortunately you have failed to comply with the conditions of the Act, which oblige you to make the information you hold available in the form I request.

I appreciate the referral to http://www.activeplacescymru.org.uk/En/i... website, but this does not provide a complete view of all data requested. Specifically it restricts requests to 15 mile radii of known postcodes, making it impossible to derive a complete view of the data held.

The Act requires you to provide the information in the requested format, so long as it is reasonably practical to do so.

I refer you to http://www.legislation.gov.uk/ukpga/2000... for the relevant legislation.

Please could you provide a copy of the database in its held format (e.g. a single database file), or in individual tables output from it.

Please could you also confirm that this data is made available under the Open Government License for public sector information.

I note that in addition, the site you have directed me to does not provide the data a form which is accessible to those with visual disability, and is not compliant with the Disability Discrimination Act 1995 http://www.legislation.gov.uk/ukpga/1995.... Given you are a public authority, this also a breach of your legal obligations.

If you are unwilling to do so, please accept this as a formal request for an internal review.

Thank you for your response. To answer your questions:

1. If you search by facility type in the second search mode in Active Places (Facility Finder) you will see the data in total.

2. We are not required under the Act to provide the information if it is easily accessible by other means, therefore the format is not an issue

3. Sport Wales has not yet made a decision as to what data under the Open Government Licence for Public Sector Information.

4. The Active Places website is about to be reviewed; if it is decided to continue to maintain the website it will meet all legal requirements, including those relating to visual disability.

As I mentioned in my previous email, if you are dissatisfied with the way in which Sport Wales has handled your request you can appeal; any appeal should be in writing and addressed to:
