Abuse of Process - Wales

Yn disgwyl am adolygiad mewnol gan Crown Prosecution Service o'u triniaeth o'r cais hwn.

Dear Crown Prosecution Service,

How many cases bought by the CPS in Wales have collapsed due to an abuse of process ruling by a judge in :-

2011
2012
2013 (so far)

What has been the cost to the public purse of these actions in the three years not above.

Ditto the above for the CPS on a UK level.

Yours faithfully,

Andrew Reeves

Dear Crown Prosecution Service,

You are late responding to my FOI request , can you please explain why ?

Yours faithfully,

Andrew Reeves

Dear Mr Reeves

I apologise that we were unable to meet yesterday's deadline in providing you with a response to your request. We are currently dealing with a high volume of requests but will aim to give you a reply during the course of next week.

Kind regards

Dear Mr Marindale

Why are you dating correspondence you sent out on the 10th of September as being the 6th of September ?

Subsequently, your response to my request is more than a day late.

Can you confirm whether the date on your correspondence was an oversight ?

Yours sincerely,

Andrew Reeves

Freedom of Information Unit, Crown Prosecution Service

Dear Mr Reeves

I can confirm that there has been no oversight on my part. I have checked and the email was sent on Friday 6 September at 15:30hrs, and should have been dated as such automatically.

If you only received this today I can only speculate that there was some delay between the Exchange servers, from leaving our system to being uploaded or notified to you on the whatdotheyknow website. I confirm that our response is therefore now 2 working days late, as at Tuesday 10 September.

Regards

Dear Mr. Martindale

You wrote & dispatched the letter dated the 6th on that day ?
I didn't receive any notification of it until four days later , however your response to my enquire of today appeared immediately on this site & I received an email informing me of its arrival simultaneously.

Moving on we have confirmed that your late in submitting your reply & we await your response. I understand the pressures of work , and suggest that it's not a defence accepted by the CPS when in pursuit others who fail to operate within the confines of the law ( as your organisation is doing at the moment ).

Would please you indicate when we are to receive the information ?

If your unable to provide a date I will request an internal review & draw it to the press' attention.

Yours sincerely,

Andrew Reeves

Freedom of Information Unit, Crown Prosecution Service

Dear Mr Reeves

I can confirm that is correct in relation to the sending of the correspondence. I am still unable to confirm the exact date that the response will be issued but it is being progressed and I think by close of this week may be possible.

I apologise again for the delay.

Dear Crown Prosecution Service,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Crown Prosecution Service's handling of my FOI request 'Abuse of Process - Wales'.

The reason you gave is spurious & incorrect in law.

Further , I believe the official conducting the review deliberately sought to mislead me regarding the date he corresponded with me & I request an investigation into that matter.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/a...

Yours faithfully,

Andrew Reeves
