A list of Hereditaments that had their Court Summonses for BID Levy Withdrawn

Dear East Lindsey District Council,

I request a list of the addresses and rateable values of each hereditaments in respect of which a Court Summons was issued for of non-payment of the BID Levy, and subsequently that summons was withdrawn.

I request that the information be provided for every such event since 1st September 2017.

For each withdrawal please provide any reason noted on the account for that withdrawal.

Please provide either the date that each summons was issued or the date that it was withdrawn

Where more than one summons was issued and withdrawn in respect of the same hereditament, please provide a separate response for each occasion.

Thank you for your reply.

I can confirm that I am unable to afford to pay the charge that you require but would like to take advantage of your offer to narrow the parameters of my request.

I request a list of the addresses and rateable values of each hereditaments in respect of which a Court Summons was issued for non-payment of the BID Levy, and subsequently that summons was withdrawn before the day of the hearing.

I request that the information be provided in respect of any summons issued between 1st April 2021 and 31st March 2022

For each withdrawal please provide any reason noted on the account for that withdrawal.

I am writing to request an internal review of East Lindsey District Council's handling of my FOI request 'A list of Hereditaments that had their Court Summonses for BID Levy Withdrawn'.

The reason given for withholding the information regarding the 10 accounts is that 'disclosure would, or would be likely to, prejudice the commercial interests of any person (an individual, a company, the public authority itself or any other legal entity).'

The disclosure of the address and the rateable value of those 10 'accounts' can have no effect commercially on any person.

Please provide the addresses and rateable values of the 10 accounts that you have identified as fitting the criteria set in the request and please explain the reasoning behind the classification of the undisclosed information requested as prejudicial to the commercial interests of any person.

Also, in what way do you expect the link to the VOA to assist in the answering of the questions?

Dear Management, Information,

The reasoning behind your refusal to provide the information is not sound, unless the Council have acted contrary to law.

Your state that: 'disclosure (that a business had a debt that was taken to Court) would be likely to be prejudicial to the commercial interests of those businesses.'

The 10 businesses in question have not been taken to Court for a debt. By your previous admissions, they had a court summons issued and withdrawn before the Court hearing and that withdrawal was not as a result of as a result of the premises paying the demand.

If the Council is acting under BID Regulations it is required to pursue any debt outstanding so the withdrawal of the summons must be for some other reason than settlement of a debt (as with the 191)

On the assumptions that the Council has not willingly acted contrary to law and you did not intend to make such a basic error when considering my appeal and would wish to correct your misinterpretation of the situation. Please review your latest response.

If you are not prepared to do so then, as there can only be two possible reasons for the early withdrawal of the summonses:
1. The business did not owe the money demanded,
2. The Council decided not to continue pursuit of an outstanding debt for some businesses but not others
so, please provide a, suitably anonymised, list of the reasons as recorded in the Council's records of why each of the 10 summonses was withdrawn.

The Council did not consider that your point 2 was a new FOI but part of
the Internal Review that was responded to as you stated: “If you are not
prepared to do so” and the Council did conduct an Internal Review.

My request was that you conduct a review of your latest response which was the internal review. My request was for a further review.

You, as expected, have not complied with that request, you have also not complied with the request for the suitably anonymised, list of the reasons as recorded in the Council's records of why each of the 10 summonses was withdrawn.

The Council acknowledge receipt of my email of 15th August and did neither of the things that I requested, one being the provision of information, the other being a second review of the response.

Nor did the Council request clarification, as you have now, at the time of receipt.

The Council have ignored my request for information under the FOIA.

Please, immediately provide the information as requested on 15th August.
