A law was quoted, please now state which law was being referred to

We're waiting for Anthony John Monks to read a recent response and update the status.

LSB CEO Matthew Hill in a 28/01/21 email -

..."and we are expressly prohibited by law from directing the SRA to take a particular course of action in relation to an individual case".

Even though I have asked Mr Hill many times to provide the "law" and relevant sections; so far he has refused. He has also blacklisted me from corresponding with the LSB.

Please provide the legislation which prevents the LSB from directing the SRA and the relevant section/s of the legislation.

Ref:20210219-01.

Not only is Section 32(5) complete mumbo-jumbo, 32(5) seems to contradict 32(2).

Please define what is meant by -
"specific disciplinary case" = ?
"specific regulatory proceedings" = ?

Also with LSB CEO Matthew Hill refusing to respond to my correspondence, how is he adhering to the Equality Act 2010 Part 3 Section 29?

Dear Mr Monks

Thank you for your emails of 7 April and 15 March 2021 in which you stated:

"Not only is Section 32(5) complete mumbo-jumbo, 32(5) seems to contradict 32(2).

Please define what is meant by -

We do not hold the information sought in the first part of your email. Specific disciplinary case and specific regulatory proceedings are not defined in the Legal Services Act 2007. Their meaning is ultimately a matter for the courts.

The LSB’s compliance with the Equality Act is summarised on the LSB website (https://legalservicesboard.org.uk/about-...) and is applicable to all staff in their role working for the LSB. In your case the application of the LSB’s unreasonable and unacceptable behaviour policy is not inconsistent with the LSB’s compliance with its obligations under that Act, including s29.

Yours sincerely

"We do not hold the information sought in the first part of your email. Specific disciplinary case and specific regulatory proceedings are not defined in the Legal Services Act 2007. Their meaning is ultimately a matter for the courts".

Why the courts? Do they speak a special language, lay people cannot understand? Obviously you have quoted legislation which is in no way relevant to the LSB refusing to regulate correctly the SRA. You also ignored my point about 32(5) contradicting 32(2).

"LSB
Final Business Plan 2010/11
Our approach
We expect that the approved regulators will act in accordance with the regulatory objectives, as required by the Act, limiting the need for us to use our direct regulatory powers, and reducing to a minimum any requirement for us to duplicate work undertaken competently by others. However, we will not hesitate to do what is necessary, should the need arise".

This gives the impression the LSB can regulate when the regulators regulated by the LSB do not fulfil their duties. Obviously this Business Plan is a number of years old but I've seen nothing to suggest the LSB ever updated their process on regulation mentioned in the LSB's Business Plan 2010/11; namely "our direct regulatory powers".

01/02/21 email from Director Holly Perry came to the decision my correspondence was persistent and repetitive. Ms Perry simply bumped me off because the LSB CEO Matthew Hill is completely out of his depth and cannot answer the simplest of questions. The Legal Services Board is in no way, shape or form a serious organisation.

The Legal Services Board breaking the law; as I said in my 09/04/21 ignored email - "The Legal Services Board is in no way, shape or form a serious organisation".

Isn't my being expected to wait nearly three months for an internal review a bit much?

All the LSB needs to do is confirm their CEO Matthew Hill lied about a non-existent law! After confirming their CEO Matthew Hill lied, the LSB then needs to discipline the man.

BoardSecretary, Legal Services Board

Dear Mr Monks

FoI request (Ref: 20210219-01) – internal review request

Thank you for your email of 20 July 2021 in which you query what you believe to be an internal review request you made nearly three months ago in respect of the LSB’s response to the above FOI request.

We have carefully checked our records and cannot find any record of having received such a request from you in respect of our FOI response dated 15 March 2021.

While the LSB is obliged only to conduct an internal review if a request for one is received within 40 working days of the initial FOI response, as we have no record of having received your request, in this instance we are treating your 20 July 2021 correspondence as a new internal review request. Please re-send us your original internal review request, and we will consider it as part of this review.

We aim to inform you of the outcome of the review by 17 August 2021. If you have any queries, please do not hesitate to contact me.

Your sincerely,

I could have sworn I requested an internal review.

"What best describes the status of this request now?

This particular request is finished:
The review has finished and overall:
They do not have the information (maybe they say who does)...

The word "review" is clearly visible.
