I am writing to request an internal review of Highways England Company Limited's handling of my FOI request 'A5 Dodwells to Longshoot Widening Appraisal Summary Table'.
I asked for confirmation that this scheme had been cancelled, as per the ORR Annual Assessment of of Highways England.
Rather than answer a simple yes/no question, HE said the information "is information we make available to the public on a regular basis. Therefore your request will be handled under normal business practices and not in accordance with the Freedom of Information Act/Environmental Information Regulations.
HE then said that "We have sent this request to the relevant department who will respond in due course."
Except no department has responded despite it being almost two months since I requested this information.
Please answer this simple question. Has this scheme been cancelled?

Longshoot Widening Appraisal Summary Table. The information you have
requested is information we make available to the public on a regular
basis.
Your request has been handled under normal business practices and not in
accordance with the Freedom of Information Act/Environmental Information
Regulations. To explain further why we contacted you to explain that your
request was to be handled under normal business practices, is that
requests under FOI or EIR need to be for physically held information and
your question was seeking confirmation of a situation. The FOI/EIR process
is the not appropriate way to handle these type of cases and there is a
separate correspondence process for business as usual (BAU) requests so we
need to pass these cases over to the appropriate team or area to handle in
the correct manner. As you contacted us through What Do They Know (WDTK)
this automatically goes into our FOI toolset rather than to the customer
contact centre and we felt the automated response you will have received
confirming that the request had been allocated an FOI reference number may
have been misleading if we had not confirmed it was being handled outside
of the FOI/EIR legislation. Please accept our apologies for any confusion
caused, the automated response has now been switched off to avoid this
sort of situation occurring in the future.
Moving now, to your follow-up of this case of 14 October 2021 where you
indicated you had not received any further communication following our
indication that your e-mail of the 16 August was be handled as BAU, we
followed this up with the area team to whom the case would have been
allocated to handle as BAU. They confirmed that a response had been sent
on 1 October but they had received an e-mail back from WDTK stating that
the reply sent had not been delivered because it was an old request that
has been marked to no longer receive responses. However, upon looking at
this again it appears the response was sent to the wrong WDTK address, it
was another one of your cases but not correct address for this case.
Therefore please see below for the response that was attempted to be sent
to you on the the 1 October 2021, we trust this now addresses your
question.
