Planning application 2/2/88/0383/03 dated 20/10/1988 proposed planning consent with conditions:-
(1)There shall be no access for the development either vehicular or pedestrian to the Public Footpath running to the East of the site.
(2) Reason:- to protect the Public Footpath and to prevent multiple access.

Did the Authority have the ownership, legal obligation/entitlement/right to propose this condition?
If yes how were these conditions be implemented and policed? Also what has changed today in respect of your policies as these concern appear to no longer apply?

However, there were 3 separate Authorities at that time and similar
numbering used for each Authority.

I understand the planning was refused but not in relation to the conditions imposed.

My enquiry is in respect of the Council Authority conditions imposed on a planning application put forward for Approval?

(1)What Policy/Legislation/Legal obligation and right/Entitlement/Ownership Rights did the Authority have to impose such conditions as at the time these were made the application was put forward for Approval?
(2) How were these Conditions be implemented and Policed and the actions to be taken if breached?
(3) What has changed today in the Authorities remit in (1) above?

My question relates to 1988 what was in place at that time of this application and the date these concerns changed, why and what has replaced them?

For clarity, confirmation is given my request is not hypothetical and does not relate to a proposed application or query over another.

When this planning application was received by the authority it was being put forward for approval with conditions. These conditions would have been applied based on Government/Planning Policies etc pertinent at that time.

My request is seeking the above that was relevant to how the planning officer at that time arrived at these conditions.

While eventually the planning was later refused the refusal was not related to the conditions applied. Therefore the conditions applied would have been legal and enforceable.
My request is solely relevant to these conditions applied by planning?

With respect to the Condition regarding the Public Footpath running to the east of the site - is this footpath owned by the authority?

I appreciate the Condition was applied to Protect the Authorities owned Public Footpath inline with Planning Policy to protect and prevent multiple access, can you define and clarify the reason behind this? Does this Planning Policy still stand/apply and can I have a copy or refer me to the appropriate section?

Also can you explain the Planning Policy of Non Standard Conditions, are they enforceable and can I have a copy or refer me to the appropriate section of this Planning Policy?

I understand that you personally would be unable to ascertain the thoughts of the previous planning officer but does the planning file for this application contain full details? If so may I have copies of the relevant information?

Dear Sir,

The ownership you would need to contact the estates section, however, it does not appear it is owned by the Authority.
We do not hold that information in planning.

All info is in the report, I have no other information.
In respect of policy, there are no policies relating to this specific issue.
It is a judgement issue based on experience and impacts of the development concerned.
For example there may be highway or pedestrian safety, or amenity issues.

I refer you back to the circular on conditions.
The enforceability of conditions is a matter tested at appeal. However, the tests for conditions are set in the aforementioned circular.

May I seek clarity in respect of these conditions noted but not in any planning policies/law and the footpath is not under the ownership of the Authority yet is a Public Footpath. So the Conditions added by the Planning Officer (if planning approved) would they have been enforceable?

Does the Authority have any jurisdiction over the footpath in question at all? If yes what does this cover?

Or is it automatically the Authority has jurisdiction over the footpath due to its registered records as a Public Footpath and being used by members of the Public. The Authorities priority is safeguard of the Public using the footpath for its legitimate reason of its registration by the Authority.
