Response to this request is long overdue. By law, under all circumstances, NHS Mid and South Essex Integrated Care Board should have responded by now (details). You can complain by requesting an internal review.

Dear NHS Mid and South Essex Integrated Care Board,

ask for the reply to be in plain English
As I have a learning difficulty
And the information is something the NHS should be easily assessable

Choice of provider in mental health

The NHS says choice in secondary mental health care providers should
1, be easily assessable including the NHS funding organization's involvement
2, not delay treatment
3, and is a Legal Right

Including NHS funding organizations.
1, What is NHS funding organizations form a GP has to use to access choice for a paiant in mental health?
2 Does exceptionality need to be shown to arrange to fund, Yes or No?

However, the Essex ccg own foi data shows no/0/Nil/zero patients have been able to access the provider of their choice since April 2014 to mid-2021 when it became a legal right.

Please do remember as I have stated previously on numerous occasions.
Answer the questions put, not a question of your own making and in a format
that is suitable for patients with learning difficulty
Please do not refer to complex CCG/ICS documentation as the NHS is supposed to make information easily accessible for patients on the issues raised regarding obtaining NHS treatment.

To help clarify
All foi questions below relate to routine treatment in secondary mental health care only.
Do not relate to TMS at all, or none routine treatment/care
Currently the only provider I am aware of that the ICS commissions is Eput.

1, What service providers does the ICS commission?
2, What ICS processes/forms etc are used by a patient's GP to choose a service provider that is not directly commissioned by the ICS?
3, Does exceptionality need to be shown to access a provider that is not directly commissioned by the ICS?
4, In 3 above would exceptionality need to be shown Yes or No?
5, Would exceptionality need to be shown for service providers commissioned by other NHS ICS’s organizations for routine treatment?
6, In 5 above would exceptionality need to be shown Yes or No?

Please see below a response without rTMS.  In an earlier response TMS was
mentioned as an example. This is because you have told us that you have
that condition.

 

Including NHS funding organizations.

1, What is NHS funding organizations form a GP has to use to access choice
for a patient in mental health?
We have explained before that if a service is commissioned then a standard
referral is required for that particular service. If the service is not
commissioned, an Individual Funding Request Form is required.

2 Does exceptionality need to be shown to arrange to fund, Yes or No?
Exceptionality needs to be demonstrated in order for us to fund something
that is currently commissioned

We have nothing to add on this.

I am writing to request an internal review of NHS Mid and South Essex Integrated Care Board's handling of my FOI request 'Choice in mental health care provider'.

I past your recent responses to NHS England on choices, NHS England choices have told me what you have stated in the FOI reply is not what has been agreed with your commisioners and NHS England.
The body says you need an IFR with exceptionality for choice beyond the services that the body commissions even if the service have a commisioning contract with another commisioning body. So as as already stated the FOI reply from the body is not following satute law or NHS England guidance on choice.

1, So who is right FOI or NHS England?
2, And if you are not right why have you been feeding me false information for more than a year?
