Emergency Active Travel Tranche 1: Cowley LTN Evaluation report data

Dear Oxfordshire County Council,

Please provide me with the underlying data that forms the key elements of the Emergency Active Travel Tranche 1: Cowley LTN Evaluation report (included in the 24 February 2022 Cabinet member for Highways Management meeting document pack). I specifically want:

The vivacity Labs data that allowed for the comparison on road usage on the LTN boundary roads and the LTN area (both "control" and LTN areas);
Journey Time data collected via INRIX;
the bus time data provided by Stagecoach;
The Air quality data collected provided by Oxford City Council;
The emergency service response time data provided by South Central Ambulance Service; and
The Cycling telematics data, collected from Strava;

For everyone but the Cycling telematics data, please ideally provide me with the data that is at it's "cleanest" - i.e. consolidated, cleaned and reviewed - but just before the various tables and graphs that are included in the report are generated from it. That is, I ideally want to see the data that underlies the graphs, to avoid me having to process that data myself to generate essentially the same graphs and tables. Only if that is not possible would I be prepared to receive the raw data, and undertake my own analysis of it. My preferred timeframe is the same as that included in the report - and earlier (as far back as 1 January 2018) and later (up to 31 January 2022) - if that data was consolidated as part of the analysis undertaken.

For the Cycling telematics data, collected from Strava, I would prefer to see the data in an earlier stage of processing, so I can conduct my own evaluation about how, at what times, and how many, bike users are using evaluated roads from this self-selected sample.

For all data types, my preferred method of receiving it is Excel.

The Council does not hold the raw data for this – only the analysis was
shared with the Council.

Re Vivacity Lab camera data: Please find attached the data provided in 2

 1. Traffic counts within LTN in file – LTN traffic counts with comparison
EIR
 2. Traffic counts on boundary routes in file – Cowley VL traffic counts
with raw data

In these files, cells have been highlighted where values have been
discounted (i.e. where a day’s traffic count was less than 10% of that
sensor’s usual daily average for that month – yellow or orange), or where
data has been extrapolated where it was missing (purple).

Re Inrix & Strava data:

The Council is withholding this information because it considers that it
falls within the exception contained in Regulation 12(5)(e) of the
Environmental Information Regulations (EIR).

Regulation 12(5)(e) states: -

12 (5) For the purposes of paragraph (1) (a), a public authority may
refuse to disclose information to the extent that its disclosure would
adversely affect –

(e) the confidentiality of commercial or industrial information where such
confidentiality is provided by law to protect a legitimate economic
interest”.

The exception is engaged because this is information is:

• commercial in nature;
• protected by law through the common law of confidence (as it is not
trivial and has not been released into the public domain) as well as
through the contractual obligations of confidence;
• The confidentiality is protecting a legitimate economic interest; and
• The confidentiality would be adversely affected by disclosure.

The Council has entered into contractual obligations with the commercial
providers of these datasets not to share the raw data with third parties,
due to commercial sensitivity. Release of the information would negatively
affect the legitimate economic interests of the provider by revealing
sensitive information or information that is of potential value to
competitors into the public domain.

The Council was obliged to consider the Public Interest Test (PIT); in
doing so, it reached the conclusion that it was in the public interest to
maintain the exception under Regulation 12(5)(e) and withhold the
information. The following arguments were considered as part of the PIT:

Factors for disclosure

 1. There is a presumption in favour of disclosure under the EIR;
 2. Releasing this information may promote transparency and increase
public awareness of issues of an environmental nature and in the
decisions the Council has made; and
 3. There is a considerable public interest in this matter.

Factors against disclosure  

 1. The likelihood of commercial damage being caused to third parties
through a disclosure of information they consider commercially
sensitive would adversely affect the relationship between the Council
and third parties and would break contractual obligations with these
entities.
 2. Disclosure of this information would be detrimental to the ability to
build a strong partnership with third parties to the benefit of the
provision of the services and the achievement of improvements in the
interests of the taxpayers.
 3. It is in the interest of the Oxfordshire taxpayer that the Council’s
contractors remain commercially viable businesses, so it is in a
position to provide the contracted services over a long term.

Having considered these arguments, the Council considers that the public
interest lies in withholding this information.
