I make this request under the Environmental Information Regulations 2004 and the Freedom of Information Act 2000. Please supply the response under whichever act results in the disclosure of the most information. In the event that the information disclosure under EIR and FOI would be the same, please disclose the information under EIR.

Please provide copies of all communications (including, but not limited, to emails with any attachments and minutes of meetings) since 25 August 2020 between Cumbria County Council and the applicants (including agents, partners and any other company or individual acting for, or with, the applicants) of planning application 1/18/9012 with regard to 1/18/9012. Please include any communications regarding the development of an incinerator at Kingmoor Park (Carlisle) even if the correspondence does not specifically mention or concern 1/18/9012 (e.g. if there has been communication about a new planning application for an incinerator at Kingmoor Park, Carlisle).

Information concerning the discharge of conditions that is available on planning.cumbria.gov.uk under 1/18/9012 need not be included, but please include the covering emails/letters relating to the discharge of conditions in your response.

Thank you for your request for information regarding Planning application,
which was received on 14/02/2022.

The council aims to provide you with the information within the statutory
timescale of 20 working days in this case the date is 14/03/2022.
Subject to the information not being exempt or containing any references
to third parties.

The council will, as a matter of routine make information available in
electronic format. Where it is not practical to do this information will
be provided in hard copy (paper). If information is required in
alternative formats e.g. language, audio, large print, etc., please
indicate this as soon as possible so the council can consider your
request.

The Freedom of Information Act 2000 define a number of
exemptions/exceptions which may prevent information being released to you
automatically. The council will make an assessment about the application
of any exemptions/exceptions and issue you with a decision letter, which
will include details of your right to appeal.

If the information you request contains reference to a third party the
council will consult with them prior to making a decision about the
release of information.

In accordance with the council's Charging Policy a fee may be charged for
supplying information. If a fee is payable you will be issued with a fees
notice. The applicable fee must be paid in full before the information is
processed and released. The statutory time limit for responses is
suspended until the council has received and processed your payment. If
payment is not received within three months of issuing the fees notice
your request will be closed.

Dear Mr Mudge,

 

I am writing to inform you that I am extending the timescale for the above
request for a further 20 working days from the current deadline date
(14^th March) taking us to 11^th April 2022.

 

“Regulation 7(1)(3) – requirement to notify the requester that the
authority needs an extension of time to deal with a request which is
complex or voluminous.”

 

The reason for this extension is due to the volume of work. I have
received over 50 separate documents from the service, each with multiple
pages (some having 20+ pages each). Each page will need redacting manually
which can take 2-5 minutes per page. As well as this, I will also need to
undertake a third party consultation. We do this when the information
relates to a third party organisation. This gives the organisation a
chance to let us know if they object to any of the information being
disclosed about them. We give the organisation 1 week to get back to us.

 

As such, your new deadline for disclosure is 11^th April 2022.

I am writing to request an internal review of Cumbria County Council's handling of my FOI request 'Communications with Applicant Regarding 1/18/9012'.

I appreciate the information that has been sent, but I am concerned that the response may not be complete. For example:

1. I can find no covering emails for the decision letters regarding the discharge of conditions shown on planning.cumbria.gov.uk. The decision letters themselves do not need to be included because they are already available on the planning website. It may be that the decision letters were posted rather than emailed, but if they were emailed, please send the covering emails.

2. Some acknowledgement emails may be missing, e.g. acknowledgements from Cumbria County Council to the following:
i) email with subject "Kingmoor ERF Discharge of Conditions documents upload for informal review" dated 11 January 2021
ii) email with subject "Commencement Letter - PDF Version" sent on 14 January 2022
iii) email with subject "Notification of Commencement of Development at Kingmoor ERF" sent on 14 January 2022
iv) email with subject "Kingmoor" sent on 27 January 2022.

3. The email requesting discharge of Tranche A conditions which the supporting statement for discharge of conditions tranche B says was submitted 26 Feb 2021.

4. There is no correspondence relating to any site visit. I understand a site visit did occur so please check that Cumbria County Council hold no record of communications regarding this site visit (either prior to or after the visit) other than the initial invitation from Stephenson Halliday in the letter with subject "IMPLEMENTATION OF PLANNING PERMISSION 1/18/9012 ENERGY RECOVERY FACILITY, KINGMOOR PARK INDUSTRIAL ESTATE" dated 21 Dec 2022 (which presumably should have been 21 Dec 2021).
