I would like to request the following information about
PSNI's staff confidentiality agreements and related
disciplinary actions:

1. Copies of all confidentiality clauses, agreements or policies that staff are required to abide by. Please include any non-standard clauses which apply to particular groups of staff, or individuals. I am expecting the release of any relevant standard clauses contained within employment contracts as well as relevant policies such as your whistle-blowing policy, and any rules guiding
staff participation in online discussion, blogging and social networking sites.

2. The number of times PSNI staff members have faced disciplinary actions or proceedings as a result of breaching these confidentiality agreements, policies and clauses.

3. A listing of these disciplinary actions broken down by the date and type of disciplinary action taken (eg verbal warning, demotion, loss of benefit, etc)

4. The number of PSNI staff that have been dismissed as a result of breaching or infringing confidentiality agreements.

5. Of those i) disciplined and ii) dismissed - How many had a defence of whistleblowing?

I would like this data annually for most recent three year period (either calendar or financial depending on how you record such data).

With respect to PSNI policies clauses and agreements only those that are currently in-force are being requested.

I would like to clarify that I am only seeking policies etc.
relating to the staff-employer relationship ie. the rules staff agree to follow as individuals.

If one part of this request can be answered sooner than others, please supply that information while you are dealing with the rest.

First thing I have to say is, what a difference it makes when the ICO become involved in a case (my case)
It is like dealing with a new police force ... there has been no more lies, i.e, the silly claims that this is 'Vexatious' and so is that. The 'Vexatious' lie was was of course simply included, used by you, PSNI (others) to cover-up wrongdoing by PSNI. It is also good to see that PSNI have stopped copying and pasting other peoples (Northumbria Polces's) wild and untrue 'Vexatious' notices.

I woud like the PSNI to carry out a review of this request. I am not at all happy with the reply. Why did you, PSNI keep me waiting so long only to claim (out of time)that my request was over the cost limit?

The PSNI have still not dealt with this request correctly. The PSNI also appear to be ignoring ICO guidance while dealing with this request. Moreover, I note that the PSNI have not supplied me with any information at all relating to my request.

Please will you now supply me with as much of the requested information as you can i.e. within the £450.00 cost limit.

You also claim in your reply of today that; "The short delay in providing the final response was due to the PSNI Central FOI Unit awaiting responses from the Districts and Departments before making a decision. I am satisfied this was appropriate and carefully considered."

Could the PSNI not have sent me an update sooner to make me aware there was going to be a delay and also to explain the reason/s for same?

I note you have asked that the PSNI "now supply me with as much of the requested information as you can i.e. within the £450.00 cost limit." and can advise that as both the original response and the response to review request have stated the cost of complying would exceed the approprite limit we do not supply a response up to the limit.

The reasoning behind why the cost is exceeded has been explained and you have been advised that you are entitled to submit a refined request which will be considered to establish if it could be completed within the appropriate limit. Unfortunately it is not simply a case of supplying information up to the limit.

I am now requesting that the PSNI supply me with detailed reason/s and also explanation for why they believe each of the above requests (1-5) is a request for personal information. I am requesting the PSNI's reason/s and explanation to my requests 1, 2, 3, 4 and 5. I am requesting above reason/s and explanation under FOIA 2000 'Duty to provide advice and assistance'

Are the PSNI stating that none of my about 5 requests falls under the FOIA 2000. If so, I am requesting above reason/s and explanation (1 - 5) under FOIA 2000 'Duty to provide advice and assistance' please explain their reasons for same.

I will be making a further complaint to the ICO if the PSNI do not deal with this request within the law and correctly. I have informed you that the request now relates to all recorded in formation (1 - 5) relating to the PSNI's FOI and DPA department/s.

With regard to your email below I can advise that the 5 questions you have supplied below had already been answered in your request F-2011-02618.

You then submitted a request F-2011-03628 asking for "all correspondence, written notes and records to and from the PSNI's Central FOI Unit including copy of their 'final response' " in relation to request F-2011-02618.

This amounted to all the correspondence we held with regard to your request F-2011-02618 and this was logged as F-2011-03628. As the information was in relation to your request this is the reason why the response provided advised you to apply through Subject Access (the information related to you ie. Your request)

The 5 questions have infact been answered under the Act in request F-2011-02618.

I note from the documents that you have released that you already had much of the requested information before I requested an internal review.

It is very concerning that the PSNI have not released all of the recorded (non exempt) information that I requested. Moreover, the PSNI have still not dealt with my request correctly.

The PSNI have also excessively redacted some of the documents, which I say is also unlawful. They have also withheld other documents and information I requested. These documents must be immediately released without the redaction's

I will be making a further complaint to the ICO about the above unless the PSNI deal with the above issues and release all of the recorded (non exempt) information I requested.

I would like to advise you that there has been a considerable delay with PSNI's internal reviews and I apologise again for the delay in processing your request for review.

Internal reviews must be carried out by an independent member of staff who has had no previous involvement in the processing of your request.

The PSNI's FOI review process has been delayed owing to the loss of our independent internal reviewer.

Alternative arrangements have now been put in place, and Legal Services are assisting in carrying out the outstanding FOI reviews.

The PSNI are satisified that the redactions are properly made under the FOIA 2000. If you remain dissatisfied with your response then you may complain to the ICO as advised in our correspondence.

This is not at all surprising as it is clear to me that the PSNI are redacting recorded information for reasons of embarrassment rather than because it is exempt.

The reason given for the long delay in dealing with review/s is far from satisfactory and it seems more to do with incompetence and also poor management within your department. The FOIA is very clear when dealing with requests and reviews.

I have now made a complaint to the ICO concerning this matter on the grounds given in my above correspondence.
