Please prove me with the complete set of responses to all three of the recent Cowley LTN consultations, which closed earlier this week. Ideally, I would like to receive this data in Excel format. I am happy to have entire sets of responses to specific questions removed, where these responses are likely to contain personal data (i.e. comments rather than "yes / no" / "scale" consultation replies. However, if possible, I would prefer to receive response data containing the first half of consultees' postcodes. This will allow me to compare "in Oxford" "out of Oxford", and "local to other parts of Oxford" responses.

Please find attached Excel spreadsheet titled, ‘19090 EIR – Cowley
Final.xlsx’ and ‘19090 EIR – Cowley Final 2.xlsx’.

 

Please note that the information is in two files as the consultation moved
over from the old platform to Let’s Talk Oxfordshire, during the process.
The information will be considered alongside other information when
reported on for Cabinet Member Decision and so wider considerations will
also be taken into account at that point.

 

We have added the “Please enter the name of the town/village only, where
you currently live or the business/group you are responding on behalf of
is based” response in order to assist with the location of respondents, as
other more granular location information may have presented information
leading to identification. As this was a free text section of the survey
the Council has redacted the following information from the disclosure:

 

 1. The addresses/location details, where provided, of some third parties
who are not Council staff.

 

The Council considers that this information is exempt from disclosure
under Regulation 13 of the Environmental Information Regulations 2004. 
Regulation 13 provides that information shall not be disclosed where it
constitutes the personal data of someone other than the applicant and that
disclosure would satisfy one of the following three conditions:

 

1. disclosure would contravene any of the data protection principles, or
would do so if the exemptions in section 24(1) of the Data Protection Act
2018 (manual unstructured data held by public authorities) were
disregarded or,

2. disclosure would contravene Article 21 of the GDPR (general processing:
right to object to processing), or section 99 of the Data Protection Act
2018 (intelligence services processing: right to object to processing).

3. on a request under Article 15(1) of the GDPR (general processing: right
of access by the data subject) for access to personal data, the
information would be withheld in reliance on provision made by or under
section 15, 16 or 26 of, or Schedule 2, 3 or 4 to, the Data Protection Act
2018, on a request under section 45(1)(b) of that Act (law enforcement
processing: right of access by the data subject), the information would be
withheld in reliance on subsection (4) of that section, or on a request
under section 94(1)(b) of that Act (intelligence services processing:
rights of access by the data subject), the information would be withheld
in reliance on a provision of Chapter 6 of Part 4 of that Act.

 

In this case, the relevant condition is the first condition. 
Specifically, the Council considers that the first data protection
principle would be breached; namely, that disclosure of the redacted
information would not be fair for the following reasons:

 

 1. The reasonable expectations of the data subjects and the nature of the
information itself leads the Council to conclude that the data
subjects could not reasonably expect that this information would be
disclosed;
 2. Neither this, nor similar information has been released into the
public domain by the data subjects or anyone else; and
 3. That the legitimate interests in the public having access to this
information do not outweigh the interests in preserving the rights and
freedoms of the data subjects.

 

In reaching this decision, the Council noted that the following
consequences may occur if this information was disclosed:

 

 1. The data subject would not expect this information to be released.

 

In light of the above, the Council considers it justified to uphold this
exemption by applying redactions to the disclosure.

Dear Oxfordshire County Council,

I am writing to request an internal review of Oxfordshire County Council's handling of my FOI request 'All of the Cowley Low Traffic Neigbourhood (LTN) - consultations responses'. My request relates specifically to the decision not to provide me with response data containing the first half of consultees' postcodes.

In the following OCC report from Thursday 29 July 2021, which focused on the plans for the East Oxford LTNs, analysis was given to responses given to very small areas of the city, including "Divinity Road", "St Mary's" and "St Clement's" - see page 57 / numbered page 25 of the report linked to below. Seeing as OCC seems to place such weight on ultra-local consultant response rates in relation to its LTN consultations, and freely publishes such findings - seemingly without any GDPR concerns - I would like to be treated equally regarding the data I seek. My request for location data is arguably less location-specific than some of the findings published by OCC itself.

Thank you for your email dated 21 December 2021. As you have indicated
that you are not satisfied with the response made by the County Council in
answer to 19090 EIR, the issue has been referred to me to conduct an
internal review.

 

My investigation

 

I have completed the internal review and have looked at the whole request
afresh. I have also looked at how the original response was handled.  On
that latter point, I can see that we replied a day later than the
statutory timeframe, please accept our apologies for this delay. 

 

Your request dated 21 November 2021 asked:

responses are likely to contain personal data (i.e. comments rather than
"yes / no" / "scale" consultation replies. However, if possible, I would
prefer to receive response data containing the first half of consultees'
postcodes. This will allow me to compare "in Oxford" "out of Oxford", and
"local to other parts of Oxford" responses.

 

In the Council’s response dated 21 December 2021, we provided two Excel
spreadsheets. As explained in the response, the reason for providing two
spreadsheets was because the consultation moved from the Council’s old
platform to the current ‘Let’s Talk Oxfordshire’ platform. As you
specifically stated that you were happy for the Council to remove entire
sets of responses “where these responses are likely to contain personal
data”, the Council only provided to you the information that fell within
the scope of your request. The Council included in its response the
“Please enter the name of the town/village only, where you currently live
or the business/group you are responding on behalf of is based” in order
to assist with the location of respondents, as other more granular
location details may have presented information leading to identification.
This information provided an indication as to whether the respondents were
in or out of Oxford, and in some cases more specific location details.

 

Following receipt of the Council’s response, on 21 December 2021 you
requested an internal review of the handling of your request, and in
particular questioned why the response did not include the first half of
consultees’ postcodes.

 

Having reviewed your request and the Council’s response, I can confirm
that the Council did not collect postcode level data as part of this
consultation and therefore the Council does not hold this information to
provide to you. I apologise that this was not made clear in the Council’s
initial response. Street level data was collected but this information if
requested is likely to be withheld by virtue of Regulation 13 EIR 2004, as
there is a risk of identification of respondents. I am satisfied that in
its response dated 21 December 2021 the Council provided all relevant
information that was held at the time of the request.
