On 24^th October 2021 Hertfordshire County Council received the following
request for information from you:

This EIR request is for all correspondence between yourselves the C.C;
Three Rivers District Council and the applicant regarding the junction
improvements and any other associated works to be carried out on the roads
and highways for this development.

 

I also ask what the costings are for the works that will be subject to the
section 278.

 

 

Your request for information has been considered under the Environmental
Information Regulations 2004. I can confirm that Hertfordshire County
Council does hold some of the information you have requested. Our response
is as follows.

 

Please find attached highways emails and responses in relation to planning
application 21/0573/FUL. Included are emails related to the original
pre-application consultation and the full planning application
consultation and the relevant responses. 

 

Regarding the S278 costs, we do not hold this information. The issue of
the cost for the Section 278 highways works would not be a material
consideration at planning stage for this application as the 278 works are
necessary to make the overall development acceptable from a highways
perspective and therefore necessary for any planning consent. The cost of
the 278 works would not be known until the developer submits their
contractor figures to our Development Management Implementation team for
consideration to agree the Section 278 bond figure. 

 

Please note that we have redacted some contents of the attachment under

Regulation 13 (1)

 

This section of the Regulations applies to any requested information which
is personal data, in that it relates to an identifiable person. The
Regulations prevent the County Council from disclosing personal data to
the public if doing so “would contravene any of the data protection
principles”. One such data protection principle (set out in Article 5(1)
of the GDPR), requires that personal data shall be processed “fairly”. In
order to process personal data fairly, the County Council must only handle
it in ways that people would reasonably expect; and not use it in ways
that have unjustified adverse effects on them.

 

In relation to your request, we hold information that relates to more
junior members of staff (those who do not report directly to an AD or
above). Along with personal details of third parties. These individuals
would have no expectation we would provide the public with details of
their names and have been removed in line with Hertfordshire County
Council general practice.

 

As part of our consideration we have noted the following Public Interest
Test reasoning:

 

The public interest arguments for releasing this information are as
follows:

 

o To release the information would show accountability for the actions
of the Council and its officers.

 

The public interest arguments for withholding the information are as
follows:

 

o That the public interest in withholding the information outweighs the
public interest in disclosing it.
o Disclosure would be an unfair and unwarranted interference with the
individual’s privacy.

 

On balance we feel the public interest is better served by withholding
this information. As it would not be appropriate, fair or lawful
processing of their personal data and we are consequently satisfied the
exemption also applies to the information you have requested.
