Update on Traveller encampment in Wadenhoe

Dear North Northamptonshire Council,

We previously submitted a request regarding the travellers ( Your ref F0365) and you responded on 06/08/21 ulrimstely that you have moved them on.

They did in fact just move a short distance along the same road.

Additionally the 2 vehicles used by the travellers are untaxed which would mean that they are uninsured.

The details have been passed to the police and no action appears to have been taken when the vehicles should have been seized.

Please provide copies of any documents/communications concerning this matter where the travellers have again encamped illegally and the council appear to be wasting tax payers money due to a lack of working in partnership permitting the travellers to commit offences including road traffic offences.

To save requesting an internal review for the previous request, please supply copies of all documents including emails between the police, council and any other persons who have communicated or raised concerns regarding this ongoing situation.

Lastly please provide costs to date of dealing with the travellers including the clear up and legal costs .

This is not correct, I believe that you are also aware that it is not correct, we are a registered Limited Company. Happy to accept an apology to prevent a formal complaint being submitted so that any other people in the future are not mislead by your department.

You have also failed to comply with the previous request fully which I could challenge but don't want to cause additional work for everyone but will leave on the back burner and give you the benefit of doubt with regards to your knowledge in this field as it was our first interaction.

I would indeed like to extend my apologies; and please be assured that I
would not have knowingly offered incorrect instruction.

 

By way of explanation, I can advise that my earlier email was steered by
the attached ICO guidance; with the below points being extracts from pages
3, 4, 5, 6 & 22 respectively:

 

‘To be valid under Section 8 a request must:

o include the requester’s name and an address for correspondence’

 

o ‘The requester can be an individual, a company or an organisation but
in each case they must provide their real name.’

 

‘Section 8 stipulates that a request for information must:

o state the name of the requester and provide an address for
correspondence;’

 

‘A requester can be an individual, a company or an organisation, but in
each case Section 8(1)(b) requires that a request for information must
include the name of the requester.’

 

‘In our view, the intention of the legislation is for the requester to
provide their real name so their request could be processed in accordance
with the requirements of the FOIA.’

 

‘Requests made through the whatdotheyknow.com website will be valid,
provided the requester supplies their real name and describes the
information concerned.’

 

However, on review of this same guidance and further to your email, I do
concede that an extract from page 9 reads:

 

‘If the request is from a company, then the authority should accept either
its full registered name or a name that exists as a legal entity (such as
a trading name) as valid.’

 

In this respect I acknowledge that you are correct, and as such I am more
than willing to offer my apologies. Further, I hope that the above can in
part support why my original understanding was as I earlier outlined; and
I trust you’ll recognise that my advice was not passed on with any ill
intent.

 

With regards to your original request F0365 we do appreciate the route
that you have opted to take – and this considered, I can assure that we
will make every effort to provide you with a response to F0491 as soon as
is possible.
