Dear Essex Police,

The Essex Police is trained to use pressure points to inflict pain and discomfort on civilians and to command their compliance through pain. For the purpose of preventing a restriction of scope by you on this claim, a pressure point is any part of the body which pressure can be applied which causes pain.

I request the following:

1. The legal basis of using such a method.
2. Copies of training manuals, procedures, guidance etc on the use of such methods.
3. A disclosure as to whether or not the use of this method is generally recorded after each use and how.
4. Copies of procedures and regulations regarding the use of this method.
5. So far as not included in number 4, details on who is allowed to use such methods and in what circumstances, what training they receive, how frequent the use of the method is reviewed on an individual basis, advice/rules/procedures on who this method can be used on and when it can be used.
6. Any risk assessments of the use of this method.

Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties
on public authorities.  Unless exemptions apply, the first duty at Section

Having completed enquiries within Essex Police in respect of Section
1(1)(a), Essex Police does hold information relating to your request,
Essex Police can confirm in respect of Section 1(1)(b) the following data:

 

Caveat:  The data is correct as at 29 June 2021.

 

1. The legal basis of using such a method.

Section 3 Criminal Law Act – which looks at the right of anyone to use
force to prevent crime or affect lawful arrest.

Section 117 PACE – which looks at force the Police only can use around
various PACE powers, i.e. Search, entry to premises etc.

Common Law – which looks at the right for anyone to defend themselves.

 

2. Copies of training manuals, procedures, guidance etc on the use of such
methods.

Use of force advice features throughout Probationary Officers initial
Personal Safety Training together with Officers Refresher Training
completed yearly.  This is a constant theme referred to throughout
training slides and discussions.

 

3. A disclosure as to whether or not the use of this method is generally
recorded after each use and how.

All Officer use of force is recorded through Officers submitting Use of
Force Forms under such circumstances.

 

4. Copies of procedures and regulations regarding the use of this method.

No information held.

frequent the use of the method is reviewed on an individual basis,
advice/rules/procedures on who this method can be used on and when it can
be used.

All Police Officers and Special Constables receive training on use of
force.  Policies and procedures are reviewed in line with force
timeframes, where they exist.

 

6. Any risk assessments of the use of this method.

Officers are required to perform dynamic risk assessments for everything
they do.  Any use of force needs to be justified by the individual and is
usually factored into an Officer’s statement following incident or arrest
where a use of force has been used.

 

7. Details of all pressure points and methods used by the Essex Police.

The NPCC Personal Safety Manual outlines a number of recognised pressure
points that the Essex Personal Safety Team teach to students, these
include:

o Ear
o Neck Side
o Collar
o Nose (bridge of any underneath).

 

These techniques are taught to both initial and refresher students.

 

8. Statistics for injuries caused by this method.

9. Details on who has authorised this method for use on the public.

All policies and procedures are ultimately owned by the Head of Profession
on behalf of the Chief Constable where they exist.

Section 16(1) of the FOIA provides that a public authority is required to
provide advice and assistance, Essex Police can confirm that injury data
relating to use of force i.e. mild, severe and medical attention can be
provided if required.  We are unable to extract injury data relating to
use of force and the Pressure Point Tactic as this is grouped under
Unarmed Skills.  If you do require further information a new request will
need to be submitted and the request will be dealt with accordingly.

 

The intention of Section 16 is to provide assistance in resubmitting a
valid request.  Please note that any advice and assistance under Section
16 regarding resubmission of a request does not indicate that resubmission
will provide a full disclosure, each submission will be assessed and if a
disclosure is deemed harmful, then the appropriate exemptions will apply.

Thank you for your patience in regard to your internal review request, we
must firstly apologise for the lack of updates from this department. The
department has struggled with resourcing and workload, therefore the level
of service provided has been below what is expected.

 

I hope the below response provides some more clarity.

 

Further enquiries have been completed with our Learning and Development
Department. Disclosure has already been provided relating to the law and
again is readily available online especially relating to PACE and the
Criminal Law act, however no further disclosure will be provided by virtue
of the following exemptions

 

Section 40(2) (3a) Personal Information

Section 31 (1)(a) Law Enforcement

Section 38(1)(a) & (b) Health and Safety

 

 

Section 40(2) Personal Information applies to third party personal data ,
together with Section 40(3)(a) This is because any disclosure of the
redacted information would breach the first data protection principle,
which states that personal data shall be processed lawfully, fairly and in
a transparent manner in relation to individuals. This is an absolute
exemption and there is no requirement to apply public interest test.

FOI is considered a broadcast to the world and not a private transaction
between the force and any applicant,.  it would not be appropriate to
share slides as the footage shows officers body worn video and includes
personal information.  Article 5(1)(a) of GDPR states that “Personal data
shall be processed lawfully, fairly and in a transparent manner in
relation to the data subject”, in the case of FOIA personal data contained
in any footage would be processed when disclosed as part of an FOI
response. Those involved in such footage would not expect such footage to
be disclosed to the open world.

 

Section 31 and 38 are prejudice based qualified exemption and there is a
requirement to articulate the harm that would be caused in disclosing
information.

Overall harm

Any release under the Freedom of Information Act is a disclosure to the
world, not just to the individual making the request.  The public expect
police forces and other law enforcement agencies to use all powers and
tactics available to prevent and detect crime or disorder and maintain
public safety. To disclose details could subsequently harm the ability of
the police service to protect the public it serves and could prejudice its
ability to perform core functions.

Factors favouring disclosure

The information requested relates to a specialised area of Policing. There
is a public interest in the community being made aware of all the facts
relating to Policing in order to ensure complete openness and transparency
as there is often speculation and rumour with regard to the use of force
within the Police Service. 

 

Factors against disclosure

The risk to public safety cannot be ignored and Essex Police has a
responsibility to ensure safety of individuals is protected at all times,
by disclosing information could compromise tactics, it could also
adversely affect public and officer safety as individuals would know
forces tactics; therefore placing individuals at higher risk

 

 

Section 38 (2)

Factors favouring complying with Section 1(1)(a) confirming information is
held

 

Confirmation of whether information is or isn’t held would provide
reassurance to the general public that police forces act in a transparent
manner demonstrating the level and experience of staffing within the force
is at adequate levels to actively prevent and detect crime or disorder and
protect the community. This awareness could be used to improve any public
consultations/debates in relation to this subject.

 

Factors against complying with Section 1(1)(a) confirming or denying that
information is held

 

By disclosing specific footage, tactics would be compromised. It could
also adversely affect public safety as individuals would know details
methods to restrain individuals, placing individuals including officers
would therefore be placed at higher risk.

 

Balancing Test 

The public entrust the Police Service to make appropriate decisions with
regard to their safety and protection and the only way of reducing risk is
to be cautious with any information that is released

Revealing tactical information regarding restraint could assist those who
have intent to cause harm, and therefore would undermine and reduce the
mechanisms in place to assist with criminal investigations and effective
delivery of law enforcement, therefore, at this moment in time it is our
opinion that for these issues the balance test favours withholding of any
further information.

Your right to complain

 

If you feel your request has not been properly handled, or you are
otherwise dissatisfied with the outcome of your request you have the right
to complain.

 

Complaints should be submitted within 20 working days from the date of

We will conduct a review to investigate your complaint and endeavour to
reply within 20 working days.

 

Please explain which aspect of the reply you are not satisfied with, and
if your complaint concerns the decision to apply an exemption it would
assist the review if you would outline why you believe the exemption does
not apply.

 

If you are still dissatisfied following our review, you have the right
under Section 50 of the Act to complain directly to the Information
Commissioner. Before considering your complaint, the Information
Commissioner would normally expect you to have exhausted the complaints
