I am writing to request an internal review of Defence Infrastructure Organisation's handling of my FOI request 'Evidence Used to Prepare JSP 850 (Public Access & Recreation)'.

I note that you have aggregated my requests, which authorities are permitted to do under the FOI Act — but as you may be aware, ICO guidance (https://ico.org.uk/media/for-organisatio...) states that requests may only be aggregated for the purposes of a Section 12 exemption if they relate to the same or similar information.

In fact, my requests concern demonstrably different pieces of information. One is regarding national policy, the other is seeking information with exceptionally limited scope of an identified area of training estate within a specific timeframe.

For this reason I believe the exemption is invalid, and request that you review your response.

Receipt is acknowledged of your email of 12 July 2021 requesting an
internal review of an aggregated response provided by the Defence
Infrastructure Organisation under the Freedom of Information Act on behalf
of the Ministry of Defence, dated 12 July 2021 (our references:
FOI2021/06282/06283/06770).

 

The Department's target for completing internal reviews is 20 working days
from date of receipt and we therefore aim to complete the review and
respond to you by 10 August 2021. While we are working hard to achieve
this, in the interests of providing you with a realistic indication of
when you should expect a response, the majority are currently taking
between 20 and 40 working days to complete.  The review will involve an
independent assessment of the handling of this request and the outcome.

Dear CIO-FOI-IR (MULTIUSER),

Thank you for your investigation and positive reply.

I would like to clarify one point with respect to outcome 16:

2021/06770 seeks information regarding *when* the lands were in use between March 1st and 31st May 2021
2021/06282 seeks information regarding *why* the lands were booked at various points during 2020.

Therefore I would consider and suggest the two FOI cannot be aggregated or linked and any relationship between the two would be disingenuous - based on date range alone if nothing else.
