I am in receipt of your response to my Freedom of Information request regarding the current building works being carried out at Retford (Gamston) Airport, in which you remind me that as it is a request pursuant to the Freedom of Information Act 2000 you have a duty to supply the information requested and the right of access is to the information and not the document.

Thank you for the 22 single-page documents contained within the 33 pdf scan attachments, which are listed by item number and .pdf/.doc filename further down.

After reading through the documents supplied it would appear that several items of recorded information may be missing:

a. Item 19 - This letter, from Peter Wade, is in response to a B.D.C letter dated 1 March 2006 which has not been supplied.

b. Item 19 - This letter, from Peter Wade, states "although we may not be legally required to enter into consultations with the planning authority...". Are there no documents by either the Planning Department or the Council’s Solicitor which refute this statement? Statutory Instrument 1995 No. 418, The Town and Country Planning (General Permitted Development) Order 1995, Schedule 2, Article 3, Part 18, Class A, states:

"Condition
A.2 Development is permitted by Class A subject to the condition that the relevant airport operator consults the local planning authority before carrying out any development, unless that development falls within the description in paragraph A.4."

The development (building works) are not described in para A.4.

c. Item 14 - This letter, from Peter Wade, refers to a "consultation period". Are there no B.D.C. documents regarding this "consultation"?

d. Item 2 - This letter, from David Armiger, states "From other discussions with Royce Marshall I understand that the proposed offices would not be covered by the provisions of Class A, Part 18...". Are there no records of these "other discussions"?

e. Item 3 - This letter, from David Armiger, starts "I refer to your email of 10 March 2008". This email has not been provided, in fact no copy of any email, or record of Gamston Aviation’s convenient change of use from a "not-permitted office" to a "permitted canteen", has been provided. Mr Armiger also mentions contacting Building Regulations and Environmental Health regarding the "canteen". No documents regarding this matter from either of these departments have been included.

f. Item 4 - This letter, from Royce Marshall, starts "Thank you for your letter of the 18th February 2008. Our subsequent telephone conversation also refers". The letter or information regarding the telephone conversation have not been included. It is unclear which of these was in relation to the building works, if not both.

I await your reply as to if this apparently omitted information will be forthcoming.

If, as your e-mail dated 2 March 2009 suggests, you consider this FoI request closed I would be grateful if you could supply the Council’s Complaints Procedure, which was not enclosed (as your "template" response stated).

I am in receipt of your response to my Freedom of Information
request regarding the current building works being carried out at
Retford (Gamston) Airport, in which you remind me that as it is a
request pursuant to the Freedom of Information Act 2000 you have
a
duty to supply the information requested and the right of access
is
to the information and not the document.

Thank you for the 22 single-page documents contained within the

pdf scan attachments, which are listed by item number and
.pdf/.doc
filename further down.

After reading through the documents supplied it would appear that
several items of recorded information may be missing:

a. Item 19 - This letter, from Peter Wade, is in response to a
B.D.C letter dated 1 March 2006 which has not been supplied.

b. Item 19 - This letter, from Peter Wade, states "although we
may
not be legally required to enter into consultations with the
planning authority...". Are there no documents by either the
Planning Department or the Council’s Solicitor which refute
this
statement? Statutory Instrument 1995 No. 418, The Town and
Country
Planning (General Permitted Development) Order 1995, Schedule 2,
Article 3, Part 18, Class A, states:

"Condition A.2 Development is permitted by Class A subject to the
condition that the relevant airport operator consults the local
planning authority before carrying out any development, unless
that
development falls within the description in paragraph A.4."

The development (building works) are not described in para A.4.

c. Item 14 - This letter, from Peter Wade, refers to a
"consultation period". Are there no B.D.C. documents regarding
this
"consultation"?

d. Item 2 - This letter, from David Armiger, states "From other
discussions with Royce Marshall I understand that the proposed
offices would not be covered by the provisions of Class A, Part
18...". Are there no records of these "other discussions"?

e. Item 3 - This letter, from David Armiger, starts "I refer to
your email of 10 March 2008". This email has not been provided,
in
fact no copy of any email, or record of Gamston Aviation’s
convenient change of use from a "not-permitted office" to a
"permitted canteen", has been provided. Mr Armiger also mentions
contacting Building Regulations and Environmental Health
regarding
the "canteen". No documents regarding this matter from either of
these departments have been included.

f. Item 4 - This letter, from Royce Marshall, starts "Thank you
for
your letter of the 18th February 2008. Our subsequent telephone
conversation also refers". The letter or information regarding
the
telephone conversation have not been included. It is unclear
which
of these was in relation to the building works, if not both.

I await your reply as to if this apparently omitted information
will be forthcoming.

If, as your e-mail dated 2 March 2009 suggests, you consider this
FoI request closed I would be grateful if you could supply the
Council’s Complaints Procedure, which was not enclosed (as your
"template" response stated).

It is now 8 full working days since your last response, which was in itself past the required date for fulfilment of your "duty to supply the information requested".

a. I have had no response from the Council's Solicitor, as indicated in your response dated 17 March 2009.

b. Your inclusion of the requested letter from Mr Askwith to Peter Wade Consultancy, dated 1 March 2006, starts with reference to earlier "recent letters and attached plans". These have not been provided.

Given that I have a letter (received outside this FoI Request) that you have not provided directly, which relates to the building works at Retford (Gamston) Airport (CAA's SRG to BDC Development Control Manager, dated 15 December 2008, received by BDC 18 December 2008) and, apparently on a whim, Mr Rowen and Mr Wells visited the site 14 days after my initial request with apparently no paperwork, it would appear that BDC are only paying lip-service to FoI Requests.

As Freedom of Information Officer your earlier implication that documents missing from the initial response, made just within the required response time, were due to relying on "a third party" to fulfil the Request do not detract from the fact that you have failed in your duties under the Freedom of Information Act 2000 to "supply the information requested" and I ask for an Internal Review.

My original FoI Request was:

"Please provide documentation with respect to the current buildings being erected at Retford (Gamston) Airport consisting of additional hangarage and a single-story detached brick building, to include any consultation "with the local planning authority before carrying out any development" as required under Condition A.2 of The Town and Country Planning (General Permitted Development) Order 1995, Schedule 2, Part 18."

Your Freedom of Information Officer's boilerplate reply states:

"The Council has a duty to confirm or deny that it holds recorded information that an applicant seeks from it and a duty to supply the information requested, subject to any exemption that may apply."

As the Council would appear to have failed in their duty within the required time, as laid out in my correspondence dated 30 March 2009, I have asked for an Internal Review to be carried out.

I have now been able to look in some detail at the request made by you
under the Freedom of Information Act. As you are aware the Council is
under a duty to confirm whether it has the relevant information and to
supply the information accordingly. You should note that the information
is the requirement, not copy documents.

The information you seek is copies of documentation relating to the
buildings being constructed at Retford. Such documentation that the
Council holds is not subject to FOI disclosure because it is accessible by
other means - namely, there is a public register which shows all planning
applications and decisions, also registered on the Council's website.

Additionally, it would not be possible in any event to copy the plans
supplied by the developer for copyright reasons.

As you are probably aware, the work in any event was carried out under
permitted development rights and as such limited information needs only to
be submitted to indicate an intention to so develop. No full application
was considered or determined by the Planning Committee [or under delegated
powers] in respect of the issues falling subject to those permitted
rights. There is therefore very limited information on the public
register.

I hope that this assists with your enquiry. If you are not satisfied
with this response then there is a complaints procedure available for you
to implement followed by a reference to the Information Commissioner -
