Re: Named and Shamed by BEIS – Statutory Minimum Wage
I refer to your Freedom of Information (FOI) request received on 15 January 2021 and your
subsequent email requests for clarification dated 4 February 2021. In response to your follow-
up queries, I can advise as follows:
1. Following is an extract from the Trust's responses to FoI 23701. "The Notice of
Underpayment set out the penalty as a maximum of 200% of the arrears paid, i.e.
£13,801.44, or 100% of the arrears if the penalty was paid by 9 April 2018, i.e.
£6,900.72. The Business Services Organisation paid the penalty of £7303.41 on
behalf of Belfast Trust, prior to 9 April 2018."
Based on the figure of arrears (£7,303.41) obviously your response contains
incorrect figures. Please arrange to issue a corrected response.
Human Resources advise that the response here should have read as follows:
The Notice of Underpayment set out the penalty as a maximum of 200% of the arrears
paid, i.e. £14,606.82 or 100% of the arrears if the penalty was paid by 9 April 2018, i.e.
£7303.41. The Business Services Organisation paid the penalty of £7303.41 on behalf of
Belfast Trust, prior to 9 April 2018.
Please accept our apologies for this error.
2. Included in the Trust's response to FoI 23701, was a copy of a letter from
Department for Business Energy and Industrial Strategy dated 3 December
2020. Please provide a copy of the Trust's letter of representation, which resulted in
BEIS's letter of 3 December 2020.
The Trust did not send a letter of representation; the Department of Health, Social
Services and Public Safety’s Workforce Policy Directorate issued the letter on behalf of
Belfast Trust. The Department should be able to provide you with a copy of their
