I am writing to let you know that we are not yet in a position to respond
to your request. This is partly because some of the information you have

This message has been hidden. On 9 April 2021 Sport England informed the WhatDoTheyKnow.com team that they had been notified by a third party of personal information present in their response. Sport England did not specifically identify the personal information in question so we did not immediately hide the response from public view. On 13 April 2021 Sport England provided a replacement response which can now be seen on the request thread. We have not reviewed the voluminous material in detail so still do not know the full extent of the personal information which was originally released but has now been redacted. As of 14 April 2021 we spotted the additional redaction of a job title, pronouns contained in email signatures, and someone's first name. It does appear that there may have been a data protection breach by Sport England here, so we have removed this original response from public view. It appears the replacement response substantively includes all the information provided in the original response, there are the same number of attachments in each response. for information received on 4 February 2021.

 

It has come to our attention that some of the documents attached to our
response of 6 April 2021 contained personal information that could
identify some of our stakeholders and employees. As personal information
is exempt from disclosure under Section 40 of the Freedom of Information
Act 2000 (FOIA), we have now carried our further redactions to these
documents to ensure that all personal information is removed.

 

We would therefore be grateful if you could treat this email as a
replacement response to that issued to you on 6 April 2021. Please note
that we have attached the same documents previously released to you
however we have carried out further redactions on some of them to ensure
that all information exempt under Section 40 of the FOIA has been removed.
We would also be grateful if you could delete the response sent to you on
6 April 2021 and appreciate your cooperation in this regard.  

 

We have now considered your request and I have set out our response below.

Sport England holds some of the information requested at points 1 & 2
above but, after careful consideration, we have decided that the following
exemptions to the Freedom of Information Act (FOIA) apply to the further
information held:

 

o Section 41 applies because some of the information was provided to us
in confidence. Section 41 is an absolute exemption, however before
using the exemption, we have to consider whether there is an
overriding public interest in the information being disclosed even if
it would breach the provider’s confidence;
o Section 43(2) applies because disclosing some of the information you
have requested would be likely to prejudice the commercial interests
of a third party. Section 43(2) is a qualified exemption, so we are
required to carry out a public interest test to determine whether the
public interest in releasing the information outweighs the public
interest in withholding it;

 

There is a presumption that information should be released unless there
are compelling reasons to withhold it. The public interest test requires a
public body to balance the public interest in withholding the information
against the public interest presumption in favour of disclosure. We have
done this by carrying out a scoring system which is set out in a tabular
form below. We have used a scale of 0-5, with 0 having the least weight
and 5 having the most weight, to determine the weight for and against each
public interest factor. The public interest factors in favour of or
against disclosure are derived from guidance and legislation and they have
also been included in the table.

Please see the attached documents. As you can see, we have redacted the
personal information from the documents as we consider this information to
be exempt from disclosure under section 40(2) of the Freedom of
Information Act 2000. The names and direct email addresses of our
non-senior, non-public facing staff and stakeholders constitutes personal
data as defined by the Data Protection Act 2018. Our staff and
stakeholders have a reasonable expectation of privacy and would not expect
us to make information about their working lives public. As such,
disclosure of this information would be neither fair nor lawful and in
direct contravention of the first data protection principle. We are
therefore refusing to disclose this information.

descriptions:

1. Any application you made in 2019 or 2020 to be a “Stonewall Diversity
Champion” or to be included on Stonewall’s “Workplace Equality Index,”
including any attachments or appendices to those applications. Please
redact personal details if necessary.

2. Any feedback you received in 2019 or 2020 from Stonewall in relation to
either application or programme.

3. Any other communication you have received from Stonewall in 2019 or
2020 unless privileged or otherwise exempt from disclosure (but if you
claim privilege or exemption in relation to any material, please say in
broad terms what the material is and the basis on which you claim to be
entitled to withhold it).

4. Full details of any equality impact assessment you carried out
connected with any of these applications (including any equality impact
assessment carried out prior to an earlier application of the same kind,
if no further assessment was done).

5. Details of the total amount of money you paid to Stonewall (i) in 2019;
(ii) in 2020, whether or not as payment for goods or services.

6. Whether you intend to continue your membership of any Stonewall scheme
