Having completed enquiries within Essex Police in respect of Section
1(1)(a), Essex Police does hold information relating to your request,
however, the obligation of Section 1(1)(b) cannot be met as Essex Police
does not hold all the information requested in a format that allows it to
be retrieved within the time and cost limits of FOI.
When responding to a request for information under the terms of the FOIA,
a public authority is not obliged to provide information if the authority
estimates that the cost of the retrieval of the information requested
would be in excess of £450 (equivalent to 18 hours work). The costs
criteria relates to a request in its entirety, which means that if we
cannot retrieve all of the information requested within the costs limit,
we are not obliged to retrieve any of the information requested.
Section 12(1) of the FOIA states that a public authority is not obliged
to:
“…comply with a request for information if the authority estimates that
the cost of complying with the request would exceed the appropriate
limit.”
The following explanation outlines the difficulty Essex Police has in
answering your request:
Essex Police are unable to accurately extract the level of detail in
relation to your request from our current systems. The information is
spread over a 7 year period which amounts to 14 boxes (two for each year);
42 folders (1 replacement folder, 1 auction folder and 1 salvage folder
for each year); approximately 2,048 individual files (940 for replacement
programs, 1,021 for auction disposals and 87 for salvage disposal);
approximately 8,035 pages (each replacement order file has minimum of 3
pages so that is 2,820 pages, each auction file has minimum of 4 pages so
that is 4,084 pages and salvage files have a minimum of 13 pages so that
is 1,131 pages). To establish if information is held would, therefore,
exceed the time and cost limits under the FOIA and would qualify as the
creation of data as the results cannot be processed by means of purely
sorting or filtering data sources or running a database query tool. There
is no requirement under the act to create data purely to answer FOI
requests.
Consequently, and to this extent, Essex Police are exempt from the duty to
provide information you have requested under the provisions of Section
12(1) of the FOIA. Therefore, and in accordance with Section 17(1) of the
FOIA, this communication must act as a refusal notice to provide all of
the information that could be interpreted as being captured by this part
of your request.
No further details in respect of unmarked or covert vehicles will be
provided by virtue of the following exemptions:

Evidence of Harm
To disclose details of unmarked or covert vehicles could cause harm to the
Police Service’s ability to protect the public it serves and could
prejudice its ability to perform core functions such as the prevention and
detection of crime. Releasing this data would give individuals with
criminal intent the intelligence required to disrupt Police activity and
target innocent members of the public. Criminals would be able to
identify in which force areas resources are weak and use this knowledge to
their advantage in furthering criminal activity around the county and the
country as a whole. The disclosure of information which is likely to
undermine the Police Service’s ability to serve the public in preventing
and detecting crime can only be considered as being harmful to the public.
Any release under the FOIA is a disclosure to the world, not just to the
individual making the request. To confirm details in respect of unmarked
or covert vehicles would undermine the security of the national
infrastructure.
Public Interest Test

Factors Favouring Disclosure
The information simply relates to National Security and disclosure would
not actually harm it. The disclosure of this information would adhere to
the general principle of openness and transparency and better inform the
public about how public funds are spent, better awareness which may reduce
crime or lead to more information from the public.
In the current financial climate of cuts and with the call for
transparency of public spending this would enable improved public debate.
Factors Against Disclosure
Security measures are put in place to protect the community that we
serve. As evidenced within the harm, to disclose details of unmarked or
covert vehicles would highlight to terrorists and individuals intent on
carrying out criminal activity who and what information is shared with
other forces, commercial businesses and law enforcement agencies.
Taking into account the current security climate within the United
Kingdom, no information which may aid a terrorist should be disclosed. To
what extent this information may aid a terrorist is unknown, but it is
clear that it will have an impact on a force’s ability to monitor
terrorist activity.
The public entrust the Police Service to make appropriate decisions with
regard to their safety and protection and the only way of reducing risk is
to be cautious with what is placed into the public domain.
The cumulative effect of terrorists gathering information from various
sources would be even more impactive when linked to other information
gathered about terrorism. The more information disclosed over time will
give a more detailed account of the tactical infrastructure of not only a
force area but also the country as a whole. Any incident that results
from such a disclosure would by default affect National Security.
S31 Law Enforcement
Factors Favouring Disclosure
The disclosure of this information would lead to a better informed public,
which demonstrates complete openness and transparency.
Factors Against Disclosure
The disclosure of this information would undermine Law Enforcement
resulting in more crime being committed. This would have an impact on
Police resources and place individuals and the general public at risk.
Patterns could be drawn which would enable those intent on criminal
activities to strategically plan offences based on this data. The force
would then be required to adapt its methods in order to continue to
prevent and detect crime.
The Police Service will never disclose information which could identify
investigative activity and, therefore, undermine their investigations. To
do so would hinder the prevention or detection of crime.
Balancing Test
The Police Service is charged with enforcing the law, preventing and
detecting crime and protecting the communities we serve and there is a
public interest argument in ensuring we are open and transparent.
However, the disclosure of Police resources which would harm the ability
of Essex Police to prevent and detect crime is a more influential reason.
As part of that policing purpose, information is gathered which can be
highly sensitive relating to high profile investigative activity.
Weakening the mechanisms used to monitor any type of criminal activity and
specifically terrorist activity would place the security of the country at
an increased level of danger.
In addition, any disclosure by Essex Police that places the security of
the country at risk, no matter how generic, would undermine any trust or
confidence individuals have in us, therefore, at this moment in time it is
our opinion that for these issues the balance test favours of
non-disclosure of the information at this time.
