Thank you for your email of 13 February 2021 where you requested the following information: 
 
I am particularly interested to read the report to which Postal Affairs Minister, Mr Paul Scully, 
refers in the quotation cited in my original request: it would appear from his remark that there is 
one report by the Department‘s Performance and Risk Committee pertaining to the risks posed 
by Horizon Litigation. I would therefore be most grateful if you would release it.   
 
If it transpires that there are more reports by the Performance and Risk Committee which 
assess the potential impacts of POL’s Horizon issues, and if you are able to locate them within 
the appropriate cost limit of my request, then I would be most grateful if you could also disclose: 
 
1: Any BEIS Performance and Risk Committee Minutes/Report which made a risk assessment 
in response to the final findings of independent investigators Second Sight. (Second Sight’s 
‘Briefing Report - Part Two’ of April 2015 led the department to commission POL to undertake a 
review of Horizon in September 2015). 
 
2: Any BEIS Performance and Risk Committee Minutes/Report which address the potential 
impacts of POL’s Horizon Litigation from the time of the Group Litigation Order of March 2017 
up to and including the present action at the Court of Appeal. 
 
Under the Freedom of Information Act 2000 ('the Act'), you have the right to:

Our Records team have carried out a digital search for the documents you are interested in. 
Based on the searches we have conducted; we have identified several documents in scope of 
your request.  
 
 
 

 
 
In relation to point 1, the Horizon risk has been flagged in two instances in 2020, prior to the 07 
October, to the Department’s Performance and Risk Committee. Annexes A and B provide you 
with a copy of the Performance and Risk Committee Reports for March and September.  
For completeness, and in answering your request at point 2, the Post Office Horizon litigation 
was also highlighted to the Department’s Performance and Risk Committee in at least two 
instances in 2019. Annexes C and D provide you with copies of the Performance and Risk 
Committee Reports for March and December 2019, respectively. The risk was also highlighted 
four times in 2018; please refer to Annex E for the relevant Performance and Risk Committee 
Report for March, June, September and December 2018. 
 
In relation to point 3, the Department has undertaken several searches and have been unable 
to find any documents in scope of your request for information on Performance and Risk 
Committee discussions on the Second Sight review into Horizon. None of the submissions and 
Performance and Risk Reports made any risk assessment specifically on the Second Sight 
report in 2015. 
 
Finally, you asked about documents from the BEIS Performance and Risk Committee which 
address the potential impacts of the Horizon Litigation from the time of the Group Litigation 
Order of March 2017, up to and including the present action at the Court of Appeal. The reports 
from the Performance and Risk Committee have been identified and shared as Annex A, B, C, 
D and E. The 2017 edition of the Performance and Risk Report does not contain a headline 
page for the Post Office Horizon risk and has therefore not been shared.  
 
As you will see we have withheld all information in the Annexes which does not pertain to Post 
Office Ltd. Given your interest seems to be on Post Office Ltd and the Governance 
arrangements and reporting mechanisms relied upon by BEIS to hold the company to account, 
specifically on the Horizon litigation, we can confirm that none of the information in the Annexes 
relates to the Post Office. Instead, it relates to other non-Horizon risks identified and reported as 
part of the Departmental risk reporting process. We are not willing to disclose this information as 
it falls within the exemption in section 43(2) of the Act.  
  
Section 43(2) exempts information when “disclosure would, or would be likely to, prejudice the 
commercial interests of any person (including the public authority holding it). Section 43(2) is a 
qualified exemption and therefore the balance of the public interest in disclosing and withholding 
information must be considered. While the release of the information would provide greater 
transparency in Government processes, we judge that it would, or would be likely to, prejudice 
the interests of the relevant public authority that holds it.  
  
There is a significant public interest in BEIS and other Government Departments receiving 
commercially sensitive information. Disclosure of the information in this case would be likely to 
prejudice BEIS’s commercial interests because people will be less willing to engage with BEIS, 
in the future if they think commercially sensitive information might be disclosed. That will 
inevitably threaten BEIS’ ability to engage meaningfully with stakeholders.  
 
In this case we consider that the public interest in withholding the information outweighs the 
public interest in disclosure.
